Mugs001
My wife and I have petitioned for my wife's daughter (over 21, unmarried). The case has gone to the NVC and we've paid all of the fees for both the I-864 and DS-230. We are just waiting now as there has been a back log of apps apparently. I want to make sure what the policy and procedure is for adding a newborn to the visa app. Can we do this? She remains unmarried of course. But then I guess we just need to send in the birth certificate and passport? Thanks for your help! Mugs Link to comment
cjr818
If you're a US Citizen and this newborn is your child. The newborn is a US Citizen regardless of where the birth takes place. You need to register the birth abroad with the US Consulate. Link to comment
Mugs001
Sorry for the confusion. The newborn is the daughter's child. She did not get married. Link to comment
dnoblett
Let me get the details clear, sounds like your spouse filed an I-130 petition for her daughter some time ago (F2B Preference) and in the mean time she had a child out of wedlock. Has a visa number been assigned? (According to NVC petitions filed before May 2004 are current) http://www.travel.st...letin_5733.html From DOS website it sounds like you will need to provide an additional I-864, and when requested for DS-230 provide an additional DS-230 for the child and pay additional visa fee for child, and submit additional documents for child. Can My Family Members also Receive Immigrant Visas? Based on your approved petition, your spouse and minor unmarried children, younger than 21, may apply for immigrant visas with you. Like you, they must also fill out required application forms, obtain required civil documents, pay the required fees, and undergo medical examinations.http://travel.state....06.html#members If were me I would be calling NVC about this and asking about this. 202-663-1225 (DOS Visa Services) 603-334-0700 (NVC)http://www.travel.st...w/how_1463.html ALSO: OPT In to the E-Mail process that DOS has set up for immigrant visas from China.
