What else is needed with form I-134?

I have filled out form I-134 and will deliver this to my fiance this weekend when I return to China. The instructions say to get a letter from my bank and a letter from my employer....which I have both. Do I need to include my W2's or tax documents from previous years as well? I keep hearing that I do and that I dont.

When preparing the I-134 it is best to understand, the Immigrations Unit of the consulate will be looking at it, and the treat it the same an the I-864, so tend to expect the same evidence recommended for the I-864 to be used with the I-134.

An IRS return is not compleat unless the supporting evidence provide the numbers on the return are attached, (W2, 1099) OR you can use IRS Transcripts instead, they are free from the IRS and easy to get.

 

The transcript can be ordered by completing a Form 4506-T (PDF) or calling the IRS toll-free at 800-829-1040 and following the prompts in the recorded message.

In my wife's case I used (Past 3 years transcripts, Employer letter, and copies of past 6 months pay stubs.)

 

 

One note, be prepared, if interview happens after April 15, the consulate has been known to demand a newer I-134 with copy of new return attached.

 

Is best to send affidavit of support over shortly after receiving packet 3 from the consulate.

So...according to this, if I send in my W2 and tax return for 2010 and 2011 that will be sufficient?

The consulate has been know to get anal about this and demanding past 3 years returns since you will be providing this when adjusting status later in the states.

 

I would provide a copy of 2011 return (1040+W2+any 1099s) and 2010, 2009 transcripts, transcripts are free, and can be ordered on line.

Make copies of the transcripts for later use when filing adjustment of status.

 

Again treat the I-134 as if it were an I-864, use same financial evidence you will use for the I-864.

  • Past 3 years Tax returns (1040+W2+any 1099s) OR Transcripts
  • Past 6 months pay stubs
  • Letter from employer.
    • Basically, your employer letter should state "To whom it may concern: (first name,last name) has been employed
      full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an
      annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company
      letterhead.

I use turbotax to prepare my taxes and file electronically. Do you know if the form 1040 that turbotax fills out is acceptable as a tax return as long as I include my W2 with it?

What I am thinking of doing is filing my 2011 taxes through Turbotax this week....then once I get my return requesting my tax transcripts from 2011 - 2009.

 

Yes should be acceptable, as long as you sign the form, even a photo copy of it is OK, signing the I-134 is swearing that all numbers, and attachments are factual, under penalty of perjury.

 

If timing is right you may be able to get a transcript for 2011, if not then use a photo copy of 1040/W2

One other thing....when you sent the tax transcripts with your I-134, did you also attach your W2s or is the transcript sufficient on it's own?

Transcript are suficient on their own, they contain all info from the return.

Since the I-134 needs to be an original signed doc and you have to mail that over to her attach the transcripts and other evidence to it.

Ugggg...I just sent the I-134 to her a few days ago. I am going to request the IRS transcripts for the past 3 returns, scan them and email them to her. Then as a back up I will email her my past 3 w-2s and past 3 tax returns. Hopefully this will be sufficient.

Scanned docs should be treated as photo copies, so should be fine, lets hope.
