knloregon
It is outrageous, but China doesn't yet have a strong system of civil law, or rules of evidence in criminal law, for that matter. In the west we have 'eminent Domain' which insures that private property, needed for a public use is fairly compensated. China does not. And many of the thousands of public protests every year revolve around this subject. The Government of China is playing with fire. Any one of these protest could get out of control and grow to national proportions at some point. But it will be hard to rally the west, even with 'ChinaSmack', since the last time something like this cracked the western conscious---was the 'nail house' in Chongqing, and what was that? 3 or 4 years ago? The °È¨·¨ wuquan fa, or Chinese Property Law passed in March, 2007 addresses that3. When the government seizes land through eminent domain, the holder of use rights in that land is entitled to compensation under the same terms as the owner of the land http://www.chinalawblog.com/2007/05/chinas_new_property_law_part_i_3.html The major impact of the Property Law is in characterization of use rights as property rightsIn other words, you OWN your home, in much the same way as homes are "owned" in the west. The government owns the land. Link to comment
