His US annual income is 36,000USD before tax.He hasn't visited me since he left.We never thought that we had to separeated so long time.He didn't file a joint tax return , because I don't have social number, that's will be a big problem ?We used to live together when he was in China for 2 years.(House rental agreement, residence permits for foreigners and receipt can prove that our relationship is ture ) Link to comment
bullmastiff Posted April 8, 2011 Report Share Posted April 8, 2011 Get an amended return.No need SSN , file a form W 7 to get ITIN with the IRS ( Individual Tax Payer Identification Number ) . He needs to bring a notorized copy of your passport ( have it notorized at the US Consulate in your location in China ). See the local IRS office where he is at now to file both W7 and amended return. Link to comment

Like Randy points out, there are many Chinese women who are Candle members.Why should they need to keep silent and only ask through their husband? We should welcome them with open arms.The fact that she knows the process speaks volumes to me as well, not as a red flag, but as proof of their relationship.They have been married for almost a year and have known each other longer. They talk about their future and what it will take to be together.My wife was only a fiancee at the time she was waiting in China. However, she knew the process quite well.Why? Because we talked everyday. The main subject was her K1 visa application and what we needed to do to get her here.She is also an independent woman and asked questions through many other different resources.Cindy strikes me as someone who is like her. From the USCIS website instructions for filling out the I-864You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years. That being said an interviewing VO can ask for anything they please. His income shouldn't be a problem. You said his income in China was 18 K and now he is making 36 K. 125% of the 2011 poverty guidelines for a family of two is $18387.00. He is still working for the same company which shows a steady employment history. The issue of who is posting at Candle or how much either of you knows about the visa process is totally irrelevant. They only care you meet the requirements and have a bona fide relationship. The fact that you have a long history together (since 2006) is good evidence of bona fide relationship. Make sure you show plenty of evidence proving that. As near as I can see your case is very strong except for one weak point. He hasn't been back to China to visit in nearly a year. Make sure you are prepared to answer this in great detail. It may be because he just transfered to a new position in the company and couldn't get time off or whatever the reason.
