Getting married in the U.S. but continuing to live in China

Which is the best way to go? Marry in Mainland China or the States? It appears the time lines are not too much different between the two K-1 or CR1.

My choice if doing now is marry overseas, and file for CR-1, yes times have changed and a K-1 wont save much time in processing.

 

CR-1 has many pros. Lower fee costs, and INSTANT green-card upon entry to the USA, CR-1 is around $848 less payed to the .GOV.

K-1's advantage is IF for some reason it is denied for Non-Bonafide relationship, you can build your relationship some more, marry and then try again for a CR-1. In the case of a CR-1 being denied, you need to deal with the denial.

 

K-1:

  • I-129F: $340
  • Consulate fee: $350
  • Adjustment of Status: $1070 (To get Green Card)
  • -----------------
  • Total: $1760

CR-1:

  • I-130: $420
  • NVC I-864: $88
  • NVC Visa fee: $404
  • ---------------------
  • Total: $912
