The new magicJack uses, without permission, radio frequencies for which cellular carriers have paid billions of dollars for exclusive licenses.

The device is, in essence, a very small cellular tower for the home.

They're dreaming, if they think this doesn't violate FCC rules. Cordless phones, bluetooth, car FM transmitters, and the like are all regulated by the FCC. A quick look indicates the company doesn't even have an experimental license to operate such a device.
