Went to GUZ yesterday, No luck

Well guys, I went to guz yesterday to file my I-130 and G-325A forms for me, my wife and her daughter. The interviewer asked to see my passport the first thing. I do not have a permenante residence permit because Im retired and not a student so I can't get the PRP. So she told me SORRY, GUZ does NOT accept an "L" visa and told me I must file the papers in the USA.

 

Now my question is what is the best way to file in the USA.

 

My Domicile (home) in California but I want all the paper work to be sent back to me here in Xiamen. (I have lived in Xiamen for the past 3 years and yesterday was our second wedding anniversary!!) So on the I-130 form Im using my China address,(B, #2 on the I-130 form). CORRECT??

 

Do I need to go to the USA just to file the papers or can I send all of them from Xiamen?

 

Since my home is in California, I guess I need to send the papers to the USCIS in Chicago.

 

Another question:

I read on CFL that some people file in Beijing with an 'L" visa then get all the paper work sent to GUZ. What is your thinking about doing that?

You can mail the petition from from China, simply go to China Post and send it to:

 

USCIS

P.O. Box 804625

Chicago, IL 60680-4107

 

Note, USCIS and NVC will not send mail to a non USA address, so make sure you have your mailing address a US address where someone in the USA can receive mail for you.

 

Secondly.

 

Beijing will only accept petitions from persons residing within their district.

 

The Beijing Field Office has jurisdiction over 18 provinces in China, four autonomous regions, four municipalities under State Council and the country of Mongolia.

 

The 18 northern provinces are: Anhui, Gansu, Guizhou, Heilonjeang, Henan, Hubei, Hunan, Jiangsu, Jiangxi, Jilin, Liaoning, Qinghai, Shaanzi, Shandong, Shanxi, Sichuan, Yunan, and Zhehang. The four autonomous regions are: Nei Mongol, Ningxia, Xinjiang, and Xizang (Tibet). The four municipalities under State Council which are: Beijing, Chongqing, Shanghai, and Tianjin.

What do you suggest I send. ALL of my paper work or just the required forms (I-130 for my wife and the G325A for her and I-130, G-325A for her daughter and G-325A for me)

By "ALL my paper work I mean the copies of marriage red book with copies of the translations and notary, copies of birth cert for my wife, daughter and me ect. Everything in my books are COPIES. Do I need to send in the orginals,(passports, birth cert etc)

Another question:

Her daughter is 10 years old. What forms are needed for her. When I went to GUZ yesterday I had a complete book for her also, I-130, G-325A

Yes your daughter's address in USA will be fine, USCIS will send Receipt and Approval notices there, and NVC will send letter there also.

 

Wife I-130 + 2 G-325A forms one fro petitioner, one for beneficiary (Wife).

 

Child will be just another I-130 no G-325A

Note USCIS only needs PHOTO COPIES of attached evidence, NOT Originals, save them for NVC or Consulate stage.

 

SEND BOTH Petitions together to USCIS in Same Envelope. Fee payment can be by personal check drawn on a US Bank. $355 per petition.

 

Later at the NVC stage, you should be able to SCAN and EMAIL the required docs to NVC from China, as well as pay the required NVC Fees on line.

I have a file that is about 1 inch thick showing co-mingling of financil resources, copies of the home title in California with my name and my wifes name on the title, emails, cards and letters and pictures of our family for the past 3 years.

No just photo copies of docs.

 

 

Since you have been living together in china, just evidence of living together is needed to establish bonafide marital relationship, copy of home title in CA showing her on it will do.

 

Save the other stuff for visa interview.

So a total of $400.00 USD for each of them, Correct?

One more question. Since I need to have my papers sent to a USA address, on the I-130 form, B #2 this is where I should put my daughters USA address, CORRECT?

On page #2, #18 is the address of our home in Calif and #19 is our address here in Xiamen, CORRECT?
