I am lining up a co-sponser incase I need one. My parents will do it but there are some questions.

My Father is on a perm diability from workmans comp. They get 3600.00 a month so they have the income required. How ever my mother says they have not filed taxes in 10 years because there income is tax free. So thus no Tax returns to provide.

Now I was thinking they could get a deposit record for the past 3 years from there bank and that may work.

What do you all think?

I'm not sure and I am sure that others will come along with better responses but they might want to file back taxes even though they do not owe any. When I sponsored my husband, I had to do that even though I was/am a student and only filed for one of the previous three years when I worked. I just filed showing no income except for what I earned in interest and then my mom filed her co-sponsor stuff.

Hope this helps and like I said I am sure someone will come over with a better idea.

I agree with this, simply filing a ZERO return will explain this.

The counselor officer can and will question why no returns, and can reject the co-sponsor.

The consulate tends to use the requirements for form I-864 with I-134.

What does the sponsor do when he/she was not required by law to file an income tax return during a given year?

If you did not have to file a tax return, attach a written explanation and a copy of the instructions from the IRS publication that shows you were not obligated to file. For general information on income tax obligations, visit the IRS website.

I failed to file required tax returns, what do I do, since I want to be a sponsor?

Failure to file a required income tax return does not excuse the sponsor from the requirement for tax returns as supporting documents. If a tax return should have been filed, the Affidavit of Support will not be considered sufficient until the sponsor has done so and supplied the appropriate copies for with the Form I-864, Affidavit of Support. If the income requirement cannot be met, but the sponsor claims to have under-reported his or her income, an original or amended tax return will be necessary to process the immigrant visa application to conclusion.
