Questions about the 3 years of tax returns.

I only sent in the 2008 tax returns with my K-1 application. My lawyer did not think this was a problem. He said I will have the 2009 tax returns to her by the time of her interview, and those will show more then enoufgh to meet the Income requirements.

 

Do I really need 3 years? I did not include 2007 because I filed with my Ex-wife and only had like 12,000 in Income, 2008 I had 19,000.00 in Income and for 2009 I should clear 25,000.00-28,000.00.

 

I know I should line up a Cosponser and my Parents will do it but they have some issues I would liek to ask about.

 

My parrents are retired and have about 3,500.00 a month in income. However they have no tax returns for the past 10 years because my father is on Disability and his income is tax free.

 

I think they can just produce bank statements for the past 3 years showing Deposits but Im not sure on this.

 

Anyone have some comments?

Chances are that they will ask for 3 years so you need to have them ready at the interview.

 

Only offer up the cosponsor if they ask for it. You need to show proof that your parents do not have to file and also showing the deposits will need to be done.

 

I believe the cosponsors have to fill out an I-134 also?

Your financial evidence lie IRS returns are not required to be sent to USCIS with the I-129F petition, USCIS is not concerned with this, the consulate is.

 

You provide copies of IRS returns or SIMPLE IRS Transcripts which can be ordered for free from the IRS.

 

And yes co sponsor is required to fill out an I-134 too.

 

Moving this, I-134 and financial support is not part of the first steps of filing, it is required at P-3~Interview stage.

Your parents have INCOME, but not taxable income.

 

It is not required that a co-sponsor pay tax - it IS required that they have income. Just be sure they show this - bank statements are nice, but the VO will have to look pretty close to see the deposits and figure out where they came from. Include a cover letter/accounting statements which shows their income and the source.

 

By the way, one option open to him is to file tax returns for the previous 3 years, showing $0 tax. He would still need the bank statements and accounting letter, but at least the tax return requirement would be satisfied. There would be no penalty for doing this.
