My SO has talked to her husband and there is still no answer on whether he will let her daughter come here with her. If he says no.....then there will be no letter from the father at the interview. I am wondering, if 5 or 6 months passs and he decides that she can come, what do we do? Can she still get the K-2, or do we need to file an I-130 for her after her mother adjust status? Randy W Posted September 3, 2009 Report Share Posted September 3, 2009 He may follow to join up to one year after her entry to the US. After that, you (as an American citizen) may file an I-130 for your "child for immigration purposes" Link to comment
