Tom and Hongyan Posted August 25, 2009 Report Share Posted August 25, 2009 My fiance has a good job which she had to join the ccp back in 1998 to get this good job.Question 1, We plan on telling she is a member of the ccp because of her work. Is there a form we can fill out and send with the #3 packet to Guanghzou when she gets her #3 packet(we are still waiting for noa2)question #2, is there anything we can do to now to prevent her visa from being delayed 1-4 month if she was to get a blue slip?question #3, her son is 20 and will be 21 in April, if my fiance gets a blue slip and a delay of 3 to 4 month would put us pass April and the boy would be 21, What can we do?We are hoping for noa2 anytime now, it has been almost 5 months and hope to have interview in Dec. or Jan. IT IS POSSIBLE to speed things up at the P3 stage - but you have to be pro-active and a demon caller. Once the casefile is at GUZ, call DOS, get a human and check for status. On the day that the status changes to 'P3 sent' - have her send in a self-generated P3 packet via EMS to GUZ. This will cut down 2 to 3 weeks on the P3, and sometimes can shave off 1 to 3 weeks on the P4 and subsequent scheduling of the interview. Have a look - this was covered in q/a format back in sep 2008 - http://candleforlove.com/forums/index.php?...c=33016&hl= AGE-OUT is a whole 'nuther matter, though - There's 2 schools of thought - 1. not 21 when AOS is filed - is ok 2. not 21 when AOS interview day occurs - is ok and they are totally opposite, IMO. dnoblett Posted August 25, 2009 Report Share Posted August 25, 2009 #1 nothing extra to send to GUZ all they want is form OF-169 and DS-230 part 1, anything else will be discarded per form OF-169. #2 Nothing can be done to prevent a delay additional processing after the interview is needed. #3 Not much, even if you were to get visas before his 21'st birth day he will more than likely age out before you can file to adjust status, and even if you manage to file AOS before age 21, USCIS is notorious in their interpretation of the law and considers that needs to be under age 21 at the time green-card decision is made, this turns into a fight. He cannot get his visa before the mother gets her's He CAN adjust status, but he must use the visa BEFORE he turns 21, and he must submit his I-485 before he turns 21. If he becomes 21 before the AOS interview, the USCIS will likely deny the application, and you're facing a drawn-out (but winnable) court battle. Can she write a letter explaining she is a member of the ccp only because of her job, and will this help or will they sometimes give a pinks instead of blue? Now about the boy, he may turn 21 before the visa is given, if this is the case, how long can it take for a visa for a family member to get a visa? Other than that, you are at their mercy for the timing. The CCP issue has not been a bar to the visa, but it will usually add the processing time. They are VERY cooperative with age-out issues, but this has the added CCP problem. As soon as you get the GUZ number from NVC, you can email them to let them know of your situation and ask how to proceed. If worse comes to worse, you will need to wait for your wife to adjust status. She will then be able to file an I-130 for her unmarried son over the age of 21. The wait for this visa is around 8 to 10 years. Link to comment
