K3 Interview for the Petitioner at a local office

Yes, it does happen in cases where the petitioner had committed a crime in the past.

 

One member Reddragon75 got denied at the USCIS stage because of this issue.

Note USCIS does run background checks of the petitioner for all visa types (K-1, K-3, CR-1)

 

The K-Visas use I-129F which has the IMBRA questions, the CR-1 (I-130) does not, however the petitioner can still be called in for finger-printing and interview.

Dan, Very true.

I have a friend here in Ohio but not a member here on CFL that went through the same crap Reddragon did and got a WHITE slip.

 

BTW the back ground check is very intensives and they will find out all about you and your past!

In Reddragon's case it looked like he was considering teaching English in China, in that case he may marry his girl over there, and then later file an I-130 petition for a spousal visa.

 

The IMBRA law for K-Visas has to do with disclosure and protection of the prospective immigrant, it does not play as big a role in CR-1 and IR-1 spousal immigrant visa cases where a couple has been living together for a while.

I filed both K-3 and CR-1 Received the dreaded IMBRA for my K-3.

 

Did they call you in? for interview?
