Filing income taxes with Chinese wife

Jing and I went to the consulate in Shenyang on 01/30/09

to have our marriage certificate and her passport verified so we

could file a W-7 (request for taxpayer indentification number),

with my 2008 income tax return. We received a certificate of

acknowledgement from the vice consul J. Nathan Bland, stamped

with the consulate seal for her passport,and our marriage certificate.

This packet was sent to to the IRS ITIN department in Austin Texas

on Feb. 27th with my 2008 tax return. After 12 weeks of waiting I started calling the IRS, today I received a notification of rejection

for Jing's W-7. I called the ITIN office and was told it was rejected

because a apostille stamp is needed. Well, all I can say is BS!!!

Is this the kind of service we receive from our government offices?

The consulates, the IRS, the NVC, the governments purpose is to help

the people, I am so tired of dealing with people in public service that

are ignorant, lazy, and totally unheplful.

I feel better now!!!

We did the same thing only at the embassy in Beijing, it was accepted

Well, IRS changed the rules this year. The current W-7 instructions, with a revision date of March 2009, no longer list documents notarized by US Consulate as acceptable. But in your case it looks like they applied it retroactively!

Ron, I think that I can say that all of us can sympathize with you about dealing with the bureaucracy of the greatest nation on earth :D . We have all had our run ins with them at one time or another.

 

Also, I know that you wanted to get the ITN # for your wife as evidence of the Bonifides of your relationship. With your two trips already, and I am sure your pictures, emails, etc. you will have plenty of proof of relationship. The only other thing I can recommend is that you should put her in and English class if her English is poor.

You can always wait until your spouse is in the USA and file an amended return.

 

 

yes kodokanron, you may wait for your spouse is in the USA and file for an amended return. i did that and i received a check for 7000 for 2007 and 2008. :rolleyes: :o :lol: wife and i are laughing to the bank.

I sent a letter yesterday to the operations manager Debbie Vaugh

with copies of the Express mail label, tracking and delivery notification

from the USPS, and copies of all the documents related to the W-7.

I stated in this letter the W-7 was rejected in error because in was delivered on Feb. 27th at 7:29am and the March 2009 revisions should not apply. Also I sent a copy of this letter and all of the above docuements to the IRS Inspector General Office. I am pissed off!!!

I have sent copies of the USPS tracking and delivery proving my

2008 tax return and Jing's W-7 were delivered on 02/27/09 to

both of my state senators with all copies of the orginal w-7

submittal and the letter of rejection, with copies of all the docuements from the US Consulate in Shenyang! So we will see if the system works or ?

Never give up until you get pink!!!
