kodokanron Posted June 8, 2009 Report Share Posted June 8, 2009 Jing and I went to the consulate in Shenyang on 01/30/09to have our marriage certificate and her passport verified so wecould file a W-7 (request for taxpayer indentification number),with my 2008 income tax return. We received a certificate ofacknowledgement from the vice consul J. Nathan Bland, stampedwith the consulate seal for her passport,and our marriage certificate.This packet was sent to to the IRS ITIN department in Austin Texason Feb. 27th with my 2008 tax return. After 12 weeks of waiting I started calling the IRS, today I received a notification of rejectionfor Jing's W-7. I called the ITIN office and was told it was rejectedbecause a apostille stamp is needed. Well, all I can say is BS!!!Is this the kind of service we receive from our government offices?The consulates, the IRS, the NVC, the governments purpose is to helpthe people, I am so tired of dealing with people in public service thatare ignorant, lazy, and totally unheplful. The current W-7 instructions, with a revision date of March 2009, no longer list documents notarized by US Consulate as acceptable. But in your case it looks like they applied it retroactively! samsong Posted June 8, 2009 Report Share Posted June 8, 2009 All I submitted was a notarized copy of my wife's bio-data page of her Chinese passport to get a ITIN. I don't know if that has changed or not.I remember also, that you can mail the passport in with the W-7 form. Link to comment

We have all had our run ins with them at one time or another. Also, I know that you wanted to get the ITN # for your wife as evidence of the Bonifides of your relationship. With your two trips already, and I am sure your pictures, emails, etc. you will have plenty of proof of relationship. The only other thing I can recommend is that you should put her in and English class if her English is poor. Wishing you all the best. Link to comment

Thanks Stepbrow, I sent a letter yesterday to the operations manager Debbie Vaughwith copies of the Express mail label, tracking and delivery notificationfrom the USPS, and copies of all the documents related to the W-7.I stated in this letter the W-7 was rejected in error because in was delivered on Feb. 27th at 7:29am and the March 2009 revisions should not apply. Also I sent a copy of this letter and all of the above docuements to the IRS Inspector General Office. I am pissed off!!! Ron & Jing Link to comment

Thanks shutterbug, I have sent copies of the USPS tracking and delivery proving my2008 tax return and Jing's W-7 were delivered on 02/27/09 toboth of my state senators with all copies of the orginal w-7submittal and the letter of rejection, with copies of all the docuements from the US Consulate in Shenyang! So we will see if the system works or ? Never give up until you get pink!!! Ron & Jing Link to comment
