Jaseball Posted March 18, 2009 Report Share Posted March 18, 2009 Getting close to 90 days and finishing up our AOS package. Just got the I-693 sealed package after a week or so of shots, XRay's. Some questions. 1) In terms of fees- when we file we want to file the I-485 and that is the large one that should include another biometrics fee, correct? 2) When we file the I-485 within 90 days we can also file a I-765, which is the work authorization without a fee at the same time if I read it correctly. 3) Form 1-131 is for AP, but what is the fee for this and it appears you can send it in with the other two forms from some of the posts I have read, but I'm not too clear. Also, it asks for a statement for why AP should be granted. I just wand some travel freedom while we wait to visit Canada and Mexico if we wish. 4) The G-325A again? I should include a copy of this that is for my wife's bio or for my bio or both? 5) Form I-864 - Unfortunately I'm inbetween careers. Got a layoff one month before her K1 was approved. Barring any sort of major disaster we should be fine, but I doubt USCIS will be that lenient. I will be asking my father to also support her. Should he be a totally separate I-864 or a supplemental? 6) Best way to mail this out? I plan on making a copy for our records. I plan on using the US Postal service, but what additional precautions should I use? Return receipt? Thanks for all the help and advice over these past long months. I'll continue to search the forums and read the directions and hopefully find some of these answers on my own. Link to comment
dnoblett Posted March 18, 2009 Report Share Posted March 18, 2009 1) $1010 includes fee for Biometric, EAD and AP. 2) File the I-764 #16 coded (C )(9 ) based on pending I-485 this is the NO FEE EAD. 3) I-131 fee is part of the $1010 paid, no justification needed other than to be able to travel home while I-485 is pending. 4) Yes a new G-325A is needed from the I-485 applicant, but NOT needed from US Citizen. 5) If father is NOT a member of your household, then he provides a complete I-864 as a JOINT-Sponsor, you still provide an I-864 as PRIMARY sponsor, even if you are un-employed. 6) USPS Priority Mail, Certified with return receipt card so can track the package. I put our status as (A)(6) instead of ©(9) That part was really confusing and I'm glad you steered us the right way and included that bit. On the updated G-325A at the very bottom it asks for an Alien Registration Number. Is this the A number on NOA2? Any other things you can think of that I may have missed? I used the flat rate box that is $9.85 online click and ship with email notifications, and tracking info all on the fly... I had a K3 and K4 so mine was very large. LGR< Link to comment

We used one US Agency (USPS) to transport our package to the other US Agency (USCIS), only USPS can deliver to the PO BOX, this is fine. The only reason to use overnight service AKA Fed-EX is if you are up against a dead-line. Save yourself a bundle and us USPS Flat-Rate Priority Mail. Link to comment

This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under ©(9) This sure is confusing. I guess the (a)(6) status is within 90 days, but any application that is tied to AOS filing should be the ©(9). I think I'll listen to good advice and use USPS with safeguards. If her K1 status expires on X day and we mail it out the day before does USCIS go by the mail out date for filing or the day they receive the package? I read about the 180 day leniency for K1 status and am not too concerned with getting it out before she is out of status, but I'm sure sending it out early doesn't hurt and it would be one major task I can check off.
