Hi everyone,

I had tried everything up to now, I hired an attorney which he requested another interview for my fiance which they will answer in couple a weeks which has a little chance, but I tried it anyway.

 

I filed a new K-1 last week, What should I do with the denial petition which Guangzhou Consulate suppose to send back to USCIS.

I emailed all information to the Senetors and Congressman, they said they get back to me next two weeks.

 

This responed I got from an attorney which I had emailed, he got back to me with his responed. It's very confusing for me:

 

"Hi. It is IMPORTANT to file your rebuttal evidence BEFORE the

new K-1 is approved.

 

 

The reason is - consulates are not supposed to deny for reasons

that were known to USCIS at the time of approval.

 

 

Do you have a receipt number yet?

 

 

I recommend you send them a rebuttal to the consulate's findings -

with evidence - as soon as you get one.

 

 

I charge $1500 for the entire process. It's best to start with

an interview though. To interview your fiance with a translator

would be $200."

 

I have to wait for a few weeks anyway to hear from Guangzhou Consulate, If they give us another interview and then I look for an attorney to find out what to do with old K-1.

 

Do anyone have any ideas or suggestion for me. I will pray to God that visa denial never happened to anyone, I can't sleep at night and she is crying. I am helpless.

This immigration lawyer is smart... if he/she understands this, then your probably working with a good lawyer.

 

The problem is... you've already filed the K-1 again without rebuttal evidence.

 

The bigger problem is... it's often difficult (or impossible) to figure out the consulate's findings.

 

There is alot that could be said about these situations but who really knows the truth of it all.

 

Honestly, I would follow that lawyer's lead.

I just like to ask a question: In what ways, can you lawyer find out what is the exact reason GUZ denied you for? Is it something you can find out too and not through your lawyer? I am just thinking that no one is more anxious than you. I am just curious though, becasue I bet after denial, every minute spent on waiting for answer is like living in hell.

 

Also, have you consider going through the CR-1 or K3 route?

We don't like the idea of getting married and I leave her in China, an I believe in Baha'i Faith and I can not marry not leave together.

 

I hired the attorney today, he will find out hopefully before next interview.

Except that it's going back to the US. Often, they will put the case in "lockdown" and provide no more information until it does go back.

 

You MAY (but most likely WON'T) hear from the USCIS in the states, if they decide to hold a revocation hearing. If not, you may be able to file a "freedom of information" request to find out anything which might be in the file.

 

The most important thing for you ( or a friend) to do, would be to watch your mailbox back in the US for any correspondence from the USCIS.

Filing a new K-1 makes this a whole differnt ball game, you need to stop soliciting advice here and work exclusively with your attorney on dealing with this matter. Follow his advice carefully and if you don't understand what he tells you ask him for clarification.

 

If the attorney you have is who I think it is, Lee is right!!!! He knows what he is doing.

Yep, that lawyer is GOOD and he knows his stuff. I had contacted him earlier, thanks to Chawls' advice. I was trying to see if he could find out what was wrong and if he could help us overturn the AP blue slip.

I found out through him, and 2 congressional laisons, and especially my letter to the president and it's resulting reply to me from a DOS chief in Washington, DC... that.....NO ONE COULD HELP US...and....we would never find out what the DOS in Guangzhou speculated and conjectured was wrong with our case, until we were denied and the USCIS maybe sent us a rebuttal letter, years later :lol: .

 

After 10 months of blue slip hell we were finally denied this past May. :lol: My options are to get back into bed with the USCIS and DOS and file another application from america and make visits to China for a couple of years as we await a new interview, or.....simply move to China to live out our bona fide relationship "in person", to hell with the USCIS and the DOS, we can always file a DCF from China, and live together in happiness while we wait, going to bed together and waking up next to each other the WHOLE FUC*ING TIME. ;)

 

Good luck to you guys with difficulties with the USCIS and DOS, I hope one of you can find a way around the razorwired electric fence the DOS guards the vital national security secret of what is wrong with your case. Myself, I failed in that quest. :rolleyes:

Hi,

I don't know that much about yet, but i think your fiance recoreds has 212(a)(6)© which we got in the denial( white paper). If you don't take care of it, you will be denied without any reason in future.

You have to get it out of her name, I'm trying to get more information about it.

Yessir, a denial is a denial, we got the same as you. I will be in america a bit longer and I will put in a change of address to another american address, with the USCIS. It's doubtful they will send me anything, but they will be able to should they decide to abide by one of their own rules. :D I just don't intend on hanging out in america for 18 months or 2 years waiting for them to "maybe" send me something.

 

By the way, we've already been denied without any reason. :D
