AOS for K-3 and K-4

As our two year wedding anniversary is coming up in a few weeks, I am starting to focus on preparing our AOS process and filing right after the first of the new year.

 

I have looked at many of the related threads here and also some supporting information over at VJ, as well as the search feature here at CFL; but still have some basic questions which do not jump right out when in the search mode for me.

 

I have gathered most of the docs we need: marriage cert, birth cert¡¯s, copies of their passports, both the K-3 and K-4 visas, copies of I-94 (which is stapled in the passport), copies of both approved notice I-797 C¡¯s for the I-130¡¯s, G-325A¡¯s, I-864¡¯s, both medical exam and shot record books from just prior to the interview in Guangzhou (May 22nd and June 6th 2008 respectively) two passport photos for each.

 

Questions: In filling out the I-485, in section #2, they only speak to the category of K-1 and K-2 visa. Is this the box that is also checked for the K-3 and K-4 ??

 

Also in section #1 of the I-485, they speak of SSN number which she does not have, so that is blank and I think they would have asked for an ITIN if they wanted it ? What about an A # ? is that also to be left blank ?? And with respect to the I-94 number, is that the control number on the top of the small card stapled to the inside of her passport at POE entry time ?

 

I gather from other threads/posts that I will do one each, I-485 and I-864 and of course the G-325A for each individual, wife and daughter ??

 

Are two photos each only required for the form¡¯s G-325A or are there photos also required for the I-485 ??

 

I am including a payment of $1010 for my spouse and $600 for my step-daughter, age 12.

 

Moreover, I see a reference to a ¡°biometrics fee¡± is this an additional $80 ?? Do I include that (add to amount) of the filing fee check for each person ??

 

I also see a mention of a finger print fee ?? How much is that fee and is that due up front now, or at a later date when fingerprints (in addition to those taken in GZ) are taken by USCIS personnel ??

 

Has anyone kept track (like we did on the I-130/I-129 visa process) of the average time it has been taking for K-3 and K-4 AOS, from date of filing until issuance of the GC ??

 

Any ideas on what percentage of app¡¯s for K-3 and K-4 that require an interview and those wherein the GC is issued without the interview ??

 

Does this change, if the marriage is over the two year mark and one is expecting the 10 year permanent GC vs. the 2 year conditional version.

 

Although not on the list, as I did with the K-3 and K-4 process, I will also include some supporting documents and data, which I think may be important to the case and the bona fides of the relationship.

You are choice "A"

She has an "A" number.. see your petition NOAs

yes

yes.. each is independent filing; don't duplicate on each others

yes... include together or as separate check; we did it as separate

this IS biometric fee

Joint ownership, joint activities and financials are most important. I took out a financial paper the night before and forget to put it back into my bag... good thing I also brought (normalliy not necessary) alternate financials... I quickly offered them instead! Can you say, "AOS Kitchen Sink"

The I-130 is required of the K-3 and K-4 and was filed over a year ago at the outset of the process.

 

I have both form I-797 I-130 approval receipts (NOA-2's) to attach to the package.

 

Thanks for the clarification on the $1010 and the $80 is inclusive !! I was aware that my daughter, under age 14 is exempt from the bio fee. Thanks.

Almost true - the I-130 is not required for the K-4, until you file AOS. You're ahead of the game there.
