EAD problem

I filed the EAD via online (hoping it would be faster) for my wife. Well I just got a Notice of Decision saying that is was denied “Service records show that the ninety-day period after entry in which the applicant may seek employment authorization has expired.” So I called the BCIS National don’t know anything about visas hotline. They said I was supposed to file the EAD with the AOS. I would have to re-apply. I called back and talked with an I can’t do anything immigration officer. They said I could request a motion to re-open the case with $100.00 fee. So I then decided to go to the local office in Phoenix and see if they could issue a temp or find out why it had been denied. After talking with the so sorry you have to re-apply and give us more money immigration officer I found out that the class it was filed under was A06 (K-1). It need to be filed under the class c09 (waiting for AOS) Ok, my $120.00 mistake. I then asked if she could change it and get her card now or at least a temp card because we have waited over 3 months. I was told I could ask to re-open the case or file again for a new one but would have to wait the 3 months because we did not take her AOS papers in personally. She told me you have to bring in your AOS papers at the same time with the EAD papers and they would give you the EAD on the spot. But I explained to her if you read the BCIS website and call the Hotline it say that you are not allowed to bring in AOS papers you have to mail them to the Phoenix office. She said well people do file them in person.

So I have re-filed and I am out another $120.00….

For those of you that don’t know me, I am one of the unlucky ones that had to wait 1yr 7 months just to get the k-1 visa (the black hole gang)
