AOS-I864

Recommended Posts

If you provide a photocopy of your tax return(s), you mustinclude a copy of each and every FormW-2 and Form 1099that relates to your return(s). Do not include copies of theseForms if you provide an IRS transcript of your return(s) ratherthan a photocopy.

You must provide either an IRS transcript or a photocopyfrom your own records of your Federal individual income taxreturn for the most recent tax year. If you believe additionalreturns may help you to establish your ability to maintainsufficient income, you may submit transcripts or photocopiesof your Federal individual income tax returns for the threemost recent years.

Sorry for the paste job. What did you give them if have no 1099

or w2? Transcript from IRS or a copy? Did you get a RFE from a

transcript or a copy? What about state taxes? Do they look at

that also? I know on 864 it says last year file is ok. Would it be

better to send last 3?. Anyone get a RFE because of this?

If you did what did you do?

Most people DO-NOT have 1099 unless they earned income on investments, or perhaps worked as an independent contractor.

The simplest thing to do is order simple IRS transcripts, they are acceptable in place of a return (1040 + W2 AND/OR 1099)

http://www.irs.gov/faqs/faq1-6.html (Call the 800 number and order them, NO 4506-T needed)

Don't think taxes - you are providing proof of income here. In your case, it sounds like it's simplest to provide the transcripts - these don't need either W-2's or the 1099's. The state taxes add no new information - they don't want these

SS long as your income is sufficient, you are good to go

If they send an RFE, simply provide the information requested.

You can include an accounting statement if you feel that will better explain your financial situation

Understand, thanks!

Do you know if they check

your state to see if your up

to date? Just got hit with

a nice tax bill from the state.

I guess its best to pay it, not

fight it given we are filling aos.

Not sure if they would give a rfe

on that.

USCIS is FED, so they are only concerned with what was reported to the FED AKA IRS.
