barnes36 Posted July 11, 2008 Report Share Posted July 11, 2008 Dear All, In December 2007 I wrote to all of you regarding my fiancee.We met as peacekeepers during a United Nations mission in S.E. Asia and decided to marry. We went through the K-1 process and I was desperately worried that because she was a police officer and a (former) member of the C.C.P., she would be refused a visa. Well...after a lengthy background check and an F.B.I. investigation of me, she arrived in the U.S. earlier this week and we will be married on monday. Now that she is here, I am a little confused about the process for obtaining resident status, work permission, Texas drivers license etc. Could one of you reading this tell me step by step the documents and procedures we will need to obtain all of these things? Also, I was told by someone that I would need to file a petition for alien relative. Is that true? Kind regards, Barnes Link to comment

You will need to file for AOS (the I-485 directions tell you everything you need there). EAD (employment authorization) and AP (travel authorization) are optional but free. K-1's can get an SS card if they apply before their visa expires. My wife was able to get her Texas driver's license without an EAD card, but others since then were not able to. So, apply for SS, get married, apply for AOS, EAD, and AP. Then when the EAD card comes in, get the driver's license. The I-130 would be needed for another relative, but not her. As for DL, I believe TX requires SSN and evidence of legal status, "EAD" OR a Green-card. AND NO you do not need to file an I-130, the AOS (I-485) is based on your K-1 visa, all you need to do is attach a copy of the I-129F approval notice to the I-485. Link to comment
