Guest lilac6451
I believe the paper you have is enough, but you should have your divorce papers translated by the notary just to be positive there is no question. We only had the divorce notary statement for our son and it was enough. I would not advise trying to get the father's permission as you don't require it according to your divorce agreement.I have my divorce papers translated by the notary.Amanda, you still have to check because the notary officials make mistakes when translating the paper work. It happened to mine. Just make sure to save trouble. Link to comment

We did not ask permission from the father as none was needed, since he didn't have custody and there was no reason to ask for trouble. Link to comment
iyan46
Amanda, My wife only had her divorce papers when we applied for her and her son's visa ... and we had no problem.. BUT ... there was no contact between the son and father for years ... he's 16 now. How old is your son, and do you think the father will contest you bringing him to the US ? Link to comment

Right now what I should do is to check paper work and to be sure it is right translation and to keep positive attitude towards the process of applying for and waiting for. Link to comment
iyan46
I asked Jing about this, She tells me that as long as your divorce papers say you have custody that they probably won't ask about it. Link to comment

Joint custody is less common in China, but on the rise and in those cases the other parents permission is requested. There are some cases where it has been requested, but not required for getting a visa. Link to comment

One thing you have to make sure that if your son's name has three chinese chararters, translating it the way you want his name appear on his future greencard unless you want to give him an English name.
