Do we need to file I-131 Application for Travel Document?

I do not know when we will travel back to China.

Maybe next summer.

 

What is Advanced Parole?

Only if in USA on a K-1 visa, AND only before getting a green-card.

 

After getting green-card, AP is NOT needed to travel out of the country and then return.

 

Advance Parole IS filing of I-131, and getting the travel doc.

 

If filing to adjust status from K-1, then file I-131 and I-765 along with the I-485, they are FREE when filed with or after filing the I-485.

 

After getting green-card, travel doc is only needed if trip will be for more than 1 year but less than 2.

Advance Parole is someone who is otherwise ineligible, being allowed back in the country (parole is immigration-speak for being allowed in the country in this way). You request permission to re-enter, BEFORE you leave.

 

K-1's are not eligible to re-enter the US, thus they must be paroled through this document

 

It is also needed for green card holders who remain outside of the US for more than 1 year.

Just to clarify:

 

- An Advanced Parole is issued to an alien who does not have permanent resident status.

 

- A Re-entry Permit is issued to a permanent resident of the U.S.

We filed AP along with AOS/EAD as it costs the same whether you do or not. Ended up not needing it as GC came fairly quickly. Can't hurt to file it as an insurance policy in case something goes wrong with AOS and she needs to travel in the interim.
