There are "NOIDS" and there are "NOIDS" Some can be overcome with a waiver (212 or 601) overstays and misrepresentations. Others cannot = ineligible ,drug, crimes, certain behaviors. Not bonafide NOIDS seem to be a "way out" for consulates / embassies all around the world. no evidence is needed. USCIS does not seem to have a clear way or willingness to reaffirm, just lets the petition die. therefore there is no clear appeal path. Randy posted some very good stuff on this in the past. I suggest you read through the FAM manual and the USCIS site to see what they say about "non bona fide" and appealing or reaffirming. Then look at the reality in regard to successful non-bona fide NOIDS. There is a very good website/forum on appeals/waivers "immigrate2us" or something like like that, they seem to specialize in 212 and 601, but can link you with good lawyers if you want. wish you all luck Link to comment
