Visa for chinese son to visit the USA?

Recommended Posts

I am a US citizen and have a chinese wife by means of the K1 Visa. Her 13 year old son still lives in China. Is it possible for her son to get a visitors visa to travel to the USA to visit with us?

I've heard that chinese parents can obtain a visa to visit the USA, Is this true? Steps to take?

If it's been less than a year since your wife arrived in the US, he can get a K-2 fairly easily. I don't think there's any problem with abandoning it without filing for AOS.

If it's been more than a year, you can file an I-130 for your step-child ("child for immigration purposes"), which would result in a green card when he arrives. Abandoning the green card by returning to China might affect his future immigration prospects.

My wife Yan has a 15 year old son and looked into having him visit for the summer. His father would desire him to finish high school in china. From talking to women on 001 no one on that board has seen a child from China get a visitors visa. The above post seem correct. It is possible to have him come to stay but to visit seems unobtainable for now.
