BillV 8-16-2004
My wife and I will be returning to China for a visit March and April, she would like to start the paperwork to bring her son who is over 21 years old and not married to America. What is the first step, will we need to take some paperwork with us to have him sign and when we return submit to the USCIS? or can we start the process now? Link to comment
Randy W
1) Have your wife file the I-130 for her son NOW. Waiting time for (over 21) son of an LPR is approximately 10 years. 2) Have her become a US citizen. Waiting time for the (over 21) son of a US citizen is closer to 5 years. AND the clock is running as of the day the original I-130 is filed. Edited March 16, 2008 by Randy W (see edit history) Link to comment
