I-797C,and Florida ID Card

Recommended Posts

Upon arrival in USA,my wife used her I-94 Entry Card to obtain a Florida ID Card, but it expired soon after receiving it,because the Entry Card expired.

Then we got married and sent all the Green Card ($1010 fee) applications to "Lock Box".

As of now,we have received I797C (Only for Employment Authorization Document).

We went again to the "ID Office" in Florida to obtain a NEW valid Florida ID Card, but they turned us away saying "You must bring "Green Card" in order to get new ID.

I think these people are confused and have VERY LITTLE experience dealing with this kind of thing.

WHAT DOCUMENT do we need to present to ID Office in order to get a new Florida ID.

(I asked this question to them and they just shrugged their shoulders and said "Green Card?". Pathetic!)

EAD is a credit card size document, you are not employment authorized until you have that card in hand, DMV, and employer wont accept the NOA, that is just a letter telling you that USCIS received the case and are processing it. EAD can take 90 days or more to get.

List of what the employer will accept as Employment Auth can be found here: http://www.uscis.gov/files/form/i-9.pdf

DMV will require SSN and EAD.

There are plenty of employers, at least here in Houston, who are happy to hire legal, and employment-eligible aliens. And above board. They have nothing to hide.

But this question regarding "Florida ID Card" (Not Drivers License).

She went to the bank alone and somehow opened a bank account, but later when she tried to transfer $300usd from her bank to her family in China, they refused because she has "no valid ID".Would not accept her China Passport or Expired K1 Visa,or her Expired Florida ID Card.

(I have no idea what ID she used to open the bank account)

I had to JOIN her bank account (making it a "joint" account)then use MY ID to send the money to China.

Florida ID is needed for many things in daily life, not only employment.

She used her "Entry Card/K1 Visa" to obtain her first Florida ID Card, but that one expired as soon as the 90 days was up.

The people at the "ID Office" say to bring "Green Card" in order to get NEW Florida ID.

This cant be accurate.

Here's the info from thier website:

How to Apply for a Florida Identification Card

Show your documents proving identity (non-U.S. citizens can use these documents as proof).

Show your Social Security card (if you have one).

Be at least 12 years of age (no age requirement in Citrus, St. Johns, and Monroe counties).

Offer proof of your correct address.

Pay the applicable fees:

Here's the list of documents you'll need. It's a long list so I didn't copy and paste the whole thing:
