settling an estate

my dad passed away a few months ago, I am the one in charge of settleing the estate, so far the only thing the attorney has done is file the nessary papers with the court, I have been doing the rest, he knows of only his property, not other assets, I think he gets a percent of the estate, how can you legally keep him from getting a larger share and is it based on his total estate

I was the executor when my Mother passed away. All attorneys have different fees, we got a straight dollar amount. You needed to negotiate that up front, sorry! ;)

I am the exuter of the estate, I just want to know if the top figure involves how much he gets, or how much can we keep from him? as he is not doing any of the work, I got the papaers from the courthouse and 5 days later I got the same from him, guess he needs to move faster if he wants his share, all help is needed.

I am unsure of what the question is here. Who hired the attorney?

 

As the executor, I would think you would have access to the agreement with him, if it was made by your father.

You have confused me with the facts so far????

 

If you hired the attorney and in the will you are the executor then the fee should have been set first?? Is this your Dad's attorney or one you hired?? The estate fee is based on a flat fee or a % depending on what the attorney stated right up front!! B)
