K1 visa or K3 visa

Ok, I know this one has had to have been talked about before and I did a search to try and find the needed info. But no such luck.

 

Here goes:

 

1. Which do you feel is better the K1 or K3?

2. Why do you feel it is better?

3. Which seem to take less time? (yea I know many month ahead to wait)

4. If you had to do it again would you choose the other one?

 

This is important because she asked which one I thought was better. My head is hurting trying to figure out which one is better.

Ok I'll jump on this one!

 

Where do i start?

I can only say what i did and what i thought was best at the time.

I'll answer Question 4 first

No, I would not. Only for the reason it worked for me this way.

Look at my time line and you will see.

 

Which do you feel is better the K1 or K3?

 

Well the K1 seams to go a little faster than the others 6 to 9 months.

As I'm sure you know how this one works.

You have 90 days to get married after entering the U.S.

Then you have AOS and all the fees that go along with it. $$$$$$$

Now with the K3 and CR1 you get married in China.

You come home and start the same process.

I-130 then I-129F and again wait!!!

 

Now in my case i filed both K3 and CR1.

Back in the days the K3 would win the hourse race and get an interview first.

CR1 always took along time to get to interview, That ways back a few years.

 

Now like i said i filed both and it was a close race between the two during the whole wait.

 

My wife got her P4 for a K3 interview only to have it changed during the interview to a CR1 interview.

Now the good thing about getting a CR1 interview and overcoming it. Is that we bypassed all the fees that go along with the K1 and K3 after entering the U.S. you know like AOS, EAD and some other's i do not remember.

 

Weeks after my wife got here she had her green card and SS#

She is working now and has only been here in the U.S. for three months.

 

So the morel of this story is How fast do you want your SO here with you and how much money do you want to spend after she gets here

 

IMO: If money is not a problem, Seeing that our government just raised the fess a few month ago. Go with the K1 or K3.

 

But then again this is IMO the CR1 is taking about this same amount of time as the others if not faster.

 

I'm sure other's will post with there ideas soon.

Neither, I would be doing the CR-1 visa.
2. Why do you feel it is better?
The new fee structure at USCIS since July 30 to adjust status from the K-Visas to immigrant status ($1010), I would be doing CR-1 visa, it costs less, takes a bit longer to process, and results in green-card upon USA entry allowing work and travel.

K-1 is the quickest, but again it has the added $1010 cost to adjust status in the USA.
4. If you had to do it again would you choose the other one?
I would choose the third option CR-1 immigrant visa.

When Yu arrived here on the K-1, she could not work, travel out of the country, get a drivers license until after marriage, and filing adjustment of status, and either getting AP (To travel) and EAD (to work and get a drivers license).

 

AP, EAD, can take up to 90 days to get, and AOS can take much, much longer to get approved.

It's been talked about before. I won't get into my views because it always starts controversy. Don't rely on which is quicker or which is better but rely on the one that makes itself available to you at the time. Also, (here it goes), try to leave time out of the equation.
