massivly confused

I just called the DHS and was told that i need to send with my AOS forms the I-765 which is an application for EAD

1 Is this really required

I hear of poeple just skipping the EAD all together

2 What should be in my AOS packet

I-485, vac sup from Civil surg. ???

I get married tomorrow and with prices getting Jacked up i want to get this done any help would be great

IF you are applying for EAD, you should send that form with the AOS forms. Otherwise, you will need to wait for the I-767 for the AOS application and include that with the I-765.

 

No, you do not need to apply for EAD, but that would mean that she wouldn't have Employment Authorization until the green card. Check processing times in your area if that is an issue, and be aware that an FBI background check can delay it (the green card) up to 1 or 2 years.

No, you do not need to apply for EAD.

 

To add my 2 cents:

 

Consider the EAD a form of her first US Gov picture ID issued.

 

It will help if you have DMV or Security Check issues.

Sounds like you missinterpreted the person on the phone from USCIS.

 

IF you want to apply for EAD along with AOS, you can send them in the same envelope to Chicago.

 

IF you decide to hold on filing for EAD you can send it in later after getting NOA1 for the AOS, and send the application to Chicago and attach a copy of the NOA1 letter to the EAD application.

 

OR IF you don't need EAD you can just file for AOS with out EAD.

 

In our case we are holding a bit on filing the EAD paperwork, to see what happens with AOS first, our plan is to file for EAD before the rate goes up July 30 if we dont see any movement on the AOS.

 

AOS package should contain the following:

  1. Payment(s) as required by USCIS. Be sure to include the payment for both the I-485 and the the fingerprinting fee*. Use a money order so you can track the payment. If a personal check is allowed, use that instead.
  2. Cover Letter. Should include a description of what your are petitioning for (I-485), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.
  3. Form I-485: Petition for Alien Relative
  4. Copy of Chinese Spouses Passport (biographical page as well as entry stamps).
  5. Copy of the Chinese Spouses K-1 or K-3 Visa from Passport
  6. Copy of NOA2 "Approval" for I-129F
  7. Copy of the Chinese Spouses valid I-94 (front and back copies)
  8. A copy of the Chinese birth certificate along with English translation.
  9. A certified copy of your marriage certificate. (If filing for your spouse)
  10. A copy of the petitioner's and/or intending immigrant's divorce documents. (If filing for a spouse, and one or both of you have been divorced before)
  11. A copy of a prior spouse's death certificate. (If filing for a spouse, and one or both have you were married before, and the prior spouse died)
  12. Two passport-type photos (see specification) of the Non US Citizen Spouse. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.
  13. G-325A (all four pages) filled out,signed and dated
  14. I-693, Medical Examination of Aliens Seeking Adjustment of Status. (If you already have this from your overseas Visa Interview submit a copy that medical check form; No fee is required in this case. If you are a K-1 fiance(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiance(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)
  15. I-864, Affidavit of Support (With supporting financial docs) We used the I-864EZ because my financial situation was simple.
  16. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)
    Include any additional required supporting documentation or photos for the EAD

Vaccination supplement from the Civil Suegeon should be included, if you got vaccinations done in Guangzhou at the time of the medical you should have a yellow book noting this, take that book to a local civil surgeon along with copy of I-485 instructions to show that K-Visa holder only need the supplement done not whole medical exam.
