Advice on I-485

Well things are moving along pretty good now. My SO made it to America on April 15. We made a trip to Las Vegas on June 4th and got married on June 6th at the Little White Chapel and spent our honeymoon at the Venetian. After returning from Vegas we went to GM to get her on my insurance then went directly to the SS office to change her status and name.

I want to proceed with the I-485 and make it so she can work as she's getting into one of those post wedding hang-ups, :lol: i.e. nagging. :rolleyes:

I'll try to keep my questions simple as there are so many things out there on the AOS that I¡¯m getting confused.

1st do I need to wait for any paperwork from SS or my certified Wedding Certificate before starting the I-485 process? Or do I need to address the Biometrics issue prior to filling the I-485? I don't know how the biometrics fits into all this or where I even get one in NW Ohio (43545). I'll stop here so this doesn't get too convoluted and confuse my simple mind.

My only concern now is starting the I-485 process and making the paperwork straight so she can seek employment ASAP.

You need the Wedding Certificate, but not the SS. You will need the I-693A vaccination supplement from a civil surgeon. If she wants to work soon, you will want to apply for EAD (some are skipping it). Apply for AP if she wants to travel outside the country. You will get a notice telling you where to go for your biometrics appointment. I'm not aware of any biometrics issue.

 

To work, all she needs is a job. Many employers will hire based on the fact that she is eligible for EAD, although she may wish to wait for the EAD NOA1 for documentation.

Last I checked, Ohio is very fast in regards to GC processing... So, may not need to file EAD really.

Last I checked, Ohio is very fast in regards to GC processing... So, may not need to file EAD really.

AP = Advance Parole travel document

GC = Green Card, or Permanent Residence card, or I-551

The wedding certificate is the fancy, hang on the wall certificate. The marriage certificate is the license that is certified by the county in which you got married that proves you are married. As others have mentioned, it is the certified marriage license needed for AOS.

The wedding certificate is the fancy, hang on the wall certificate. The marriage certificate is the license that is certified by the county in which you got married that proves you are married. As others have mentioned, it is the certified marriage license needed for AOS.

Yep in NY we applyed for the license, and NY requires a wait of 24 hours before can use the license, we married in the town courthouse on a Friday morning, and the Certificate showed up in the mail a day later.

 

Too late now, but it is recommended that when getting married in Las Vegas, that you take the completed marriage license back to the county clerk's office rather than having the marriage official do that for you, this way you can walk out of the clerk's office with the official marriage certificate in hand, rather than having to wait a few weeks for it in the mail.

You can enclose a copy of the certified certificate.

 

USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.

 

At the discretion of the officer, original documents may still be required in individual cases. Please be advised that USCIS no longer returns original documents submitted with the exception of Certificates of Naturalization, Forms I-551, Permanent Resident Card, Forms I-94, Arrival/Departure Document, valid passports, or those specifically requested by the officer. Such documents will be returned when they are no longer needed.

So DO NOT send them any originals that you cannot replace, like I-94 card, birth certs ect. Only the I-485 G-325A ect need to be original forms, and you keep a copy of those.

You want to file with a 'certified copy'... I've heard of many RFEs due to it not being certified.. and you don't want them deciding to just return the entire packet to you either.

 

I would wait for the proper document...

However, if she is stuck in name check, then she may have to wait for green card and can't work without EAD. Best advice is to get AP and EAD also. After July 31, the new fee with AOS will include AP and EAD.
