I'll probably have a million questions about this, but on the I-485, can I be the person preparing the form and just have her sign it?

That is what we did, the form is a fillable PDF so anyone can do the typing, just check it several times for mistakes.

Be sure to acknowledge on the form that you are the one who prepared it. Also include a G-28 "Entry as a Representative" form in your filing. This will get an additional copy of all correspondence mailed to you and , most importantly, allow you to discuss the case with USCIS.

what if my certified marrage lic is in her Maiden name ??

if her passport is in her maiden name will i have to change it to the name above?

or would it be best just to have everything filled out using her maiden name ??

Did you specify married name on marriage licesence? If you did you may want to get it corrected on the marriage certificate before filing for AOS.

 

No need to get name changed yet in passport, if you do travel, just book her name in maiden name for airline tickets.

 

As for filling AOS in maiden name, If you want married name on green-card you have to options, file AOS in married name, or later file I-90 to get the name changed on the green card, and pay a fee for filing I-90 which at that time will be $370 or just wait to lift conditions and that time file the paper work in married name.

Our marriage licence is in both our family names. My wife took my last name. We filled out the I-485 in her married name and used her maiden name as her middle name. Do the same at social security. fill it out in her married name and take a certified copy of your marriage license with you.
