tcrocks38 Posted May 30, 2007 Report Share Posted May 30, 2007 I was just at the office to get a SSN and was told i need an EADAnother $180 to file. here in minnesota you need a SSN to get married.I need a SSN to Get SO under my med Insurance.Ok questions for a K-1 Application1) What forms must i fill out i just filled out the I-7652) how long does it take. 3) how do i open this beer being my fingers are worn to the bone for reaching into my pocket for my billfold Link to comment

Your wife does NOT need a SSN to get married in MN. In fact, in NO state is the SSN absolutely required. I've taken a look at the marriage license form for MN Arkon county (http://www.co.anoka.mn.us/v1_departments/div-governmental-services/dept-license-bureau/pdf/marriage-license-application.pdf)and if you'll note, it specifically says:TENNESSEN WARNING FOR THE COLLECTION OF SOCIAL SECURITY NUMBERS: If you have a Social Security Number you are required by federal, and state law to put it on the Marriage License Application (Title 42, US Code Sec 666(m)(13)(A), MN Statutes, Section 144.223 and MN Statutes, Sec 517.08 Subd 1a (1997). Your Social Security Number is reported to the MN Department of Health and will be kept private. If necessary your Social Security Number may be used to help obtain financial support of your child. So, as you can clearly see, a SSN is only required if you have one. That is to say, if you had one, you must report it by law, but if you don't have one, you're NOT required to get one for the purpose of marriage. NO state in our union bars legally present foreigners from marrying in the US. That is to say if a legal visitor from France or Brazil or Japan or China came over and suddenly fell in love and wanted to marry, NO state in the US bars them from marrying a USC due to the lack of a SSN. In ALL 50 states, if the SSN is required, it's ONLY required if the person has a SSN. If they do not have a SSN, state such, and show the county government that the person visiting is legally present in the US (offer them the visitors foreigner passport with the valid I-94 form) and that should suffice in all 50 states. So for the purpose of your marriage, a SSN is NOT required. But for the purposes of your medical insurance, it may be required. And thus you do need to get her a SSN ASAP. But I do want to clarify for everyone that a SSN is NOT required in any state if the person has a foreign passport and is legally present in the US (i.e. has valid I-94). Good luck. Link to comment

The paperwork Ling signed at the office specifically stated that she was eligible to work. I read the statement to the SS Clerk and asked if that was correct. He concurred. I told him that many have reported that in spite of the law, they are receiving SS Cards stamped "not eligible for work...." He said that is incorrect. Ten days later Ling got her card stamped "not eligible for work...." So it isn't the local office that is making the error. Someone, somewhere else is violating the law and someone with deep pockets needs to hire a lawyer and get this fixed. Link to comment

Where is this magical "DHS authorization"? It's an EAD right? But the law says a K1 is eligible to work without an EAD. The local SS office confirmed that. Ling's application that we signed does not say "eligible to work if you also file and AED and wait 90 days." That is the point. A K1 is eligible to work. Period. The problem is getting a SS Card that comes without additional requirements from DHS. Link to comment
