what the hell is that???

I went to the green card interview today. Everything is going fine except the officer told me that the status of my Background check is pending. So he couldn't give me green card. We asked if the FBI finished the background checking, do we have to come back interview again? He said:"No, we needn't go back again. The green card will mail to us when the background check is finished".

 

So I was very confused weather he approved my case or not???

 

There is another question alwasy hung in the head. If they didn't finish my background check, why do they ask me to go to interview????

 

By the way, Where can I track the process of the background check??

Getting the greencard after the AOS appointment can take days, weeks, months, even years! No one knows.

There's been a few who've gone through this including my stepdaughter. She is still waiting after her AOS appointment in December 2005.

All you can do is wait. You can call the USCIS toll-free number but they can't help you other than verify that your case is still active and not foregotten about.

There is no way to track a background check.

Yes....the black hole of namecheck. It can be extremely trying on the nerves. Especially since you can't track it....and because every case is different, no pattern can be established. The IO at our AOS interview told us that if the family name of your SO is a common one (in China most all are common) it will take longer. Our's took 5 months to complete after our AOS interview. But there are several around her who have namechecks which began over a year ago..... <_<

 

Hang in there and try to keep the faith that it'll happen! If you are thinking of taking any trips back to China in the next 6-12 months, I'd suggest you apply for Advance Parole. For AOS cases AP is processed through the MSC and they are taking 90-120 days to process (currently they'rej working on Mid-December applications).

Welcome to the club (see my time-line). The best advice I can provide is to settle down and be prepared to wait.

 

There is nothing you can track, nobody can or will tell you anything, and there is not a single thing you can do about it. It could take 5 months or 5 years and no one in the Federal Government cares.

 

That's the harsh reality of being Approved -Pending Name Check (that's your status).

This is really piss me off!! Without that damn green card, I can do nothing!!! I am like the bird in the cage!! I couldn't register in School; I couldn't apply drive liscence; couldn't go out fine a job!! Damn it! and the name in my socail Security card is still my original name,without green card, I also couldn't change it.

 

Is there anyway I can make some progess, for example, applying driving liscence or register in School???

Some state DMV's can use your I-797C notice of action for the I-485. This is a "secondary" proof of legal presence. There are four (4) items necessary:

  • proof of legal presence
  • proof of identity
  • proof of residence
  • SS number

Go armed with these and argue your case.

The same with the school you want to attend.

Yes you can do things, apply for EAD, SSA will change your name on your SS card with the EAD, employers will give you a job with the EAD card, most states will issue a drivers license to you you just need EAD, and SSN, and something else showing residence in the state.

It takes every bit of 90 days to get the EAD card.

jxry can take the required doc's to DMV next week and get the driver's license. jxry might have to do battle though. It depends on what state jxry resides in but from the several state DMV websites I've looked at, they all list the I-797 as a secondary proof of legal presence. That's how I got my wife's DL after her first one expired right along with her EAD card. The people at DMV were dumbfounded but I straightend them out! I printed off what I thought I needed to make my case before going to the DMV office and it worked. It's their laws, the state laws, but hardly none of the employees knew it. They'll just try to brush you off. Don't let them do that to you!

It's worth a try, jxry! Go to your state's DMV website and in the search field, type legal presence. See where it leads you. Print off any info you think could be of help.
