What type of SSN card do they gave you?

they issued me a "valid for work only with DHS athorization" SSN. When I went to talk to them they said "you are free to work with no obligations however we just issue this type of card to all K1 visa holder"

 

I am really mad. Are they telling me that I can just ignore what's on the SSN and go ahead right to work?

 

I was a K1 visa holder when I applied for SSN 10 days after entered America.

 

Anybody has a clue??

Do you have your EAD card or the I-551 stamp?

I've called the SSN many times and went to their office in person. I showed them all the ruling they have and they did agree with me that a K1 visa should be issed a "valid for work" visa. They just dont want to admit that they made a mistake and there's a dismatch between they system they use to issue cards and they policy they have.

You got one, guy. If it were NOT authorized for work, you would have been required to show that an SSN was required by some government agency. You can remove the restriction when you get your green card.

I think that employer's are expected to ask for specific types of identification, which would include an Employment Authorization card. There are employers who would hire you in preference to someone who might be illegal. And as long as you have applied for and can provide the EAD card within 60 days, no one would be accused of a violation.

 

As to whether this is legal or not, well it's safer to wait for the EAD card.

 

The SSN allows them to put you on the payroll. They can be required, if audited, to furnish a copy of your EAD within 60 days (or whatever the time limit is there).

 

Basically, no, the SSA does not provide employment authorization. The DHS does that.

SSA issues 3 types of cards:

  • The first type of card shows your name and Social Security number and lets you work without restriction. We issue it to:
    • U.S. citizens; and
    • People lawfully admitted to the United States on a permanent basis.

    [*] The second type of card shows your name and number and notes, “VALID FOR WORK ONLY WITH DHS AUTHORIZATION.” We issue this type of card to people lawfully admitted to the United States on a temporary basis who have DHS authorization to work.

    [*] The third type of card shows your name and number and notes, “NOT VALID FOR EMPLOYMENT.” We issue it to people from other countries:

People with Green Cards and Citizens get the unrestricted one.

People with K-1 visa and EAD get the one with VALID FOR WORK ONLY WITH DHS AUTHORIZATION.” K-1 holders are considered to be work authorized by the SSA for the 90 days of their I-94 card, and K-1 holders may get an EAD stamp at JFK POE, other wise the disclaimer indicates that the person needs EAD for the SS card to be valid.

 

They are correct in issuing the card with the disclaimer, you need to apply for EAD when you adjust status if you want to work while waiting for green card.

 

After you get green card you can go to the SSA and have that disclaimer removed. And if you naturalize and become a citizen, you need to inform SSA of this change in status, and they will note that in their system.

3. that is very strange logic that you are considered as "allow to work with no restriction" yet they give you a card say "valid for work with DHS athorization"..

2. Nobody, except on a "Authorization pending" basis

 

You are ONLY getting an SS card. The SSA does NOT authorize you to work.

 

The USCIS will issue the EAD card when you apply, which is your employment authorization.

 

What are you confused about??
