I called USCIS today with a few little questions, after 30 minutes on hold the lady asked what I needed. I asked her about K-3 and if I could request an RFE, she said she didn't know, then I asked her, about 4 little questions on the I-864. Do I enter my wife's first name as one name, or middle name a first name since Chinese first names have 2 parts and most American first names are one part? Do I use her temporary SSN? What qualifies as proof of residence for a household member?

 

Well, I'll have to transfer you to an immigration officer please hold...*musical interlude* *click* ...nothing....HELLO? HEEELOOOO? HEllooooOoO? *dial tone*.....apparently they confused the LINE 1 button with, let's lay down the handset.

 

30 minutes later got through again....repeat...lady says call DOS she doesnt know. Asked about K3, she says that's a DOS matter but they are processing up to March 5. I call the number she gives me, it's all a recording, no option to speak to anyone, just numbers to call in case of immigration emergency and what not...and something about barcoding a passport. No one to speak to.

 

 

So I have decided to enter her name as Ying (first) Ying (middle) (Zhao) last. Leave SSN blank.

 

I just need to know what qualifies as proof of residence for household member? Driver's License copy?

No, you cannot request an RFE. They'll send it when they send it.

 

When your wife tells you her name, is Ying Yingzhao then her family name is YING and her first name is Yingzhao. She has no middle name. The americanized display of her name would be Yingzhao YING or on a drivers license YING, Yingzhao. On the other hand, you have already stated your wife's name on the I-130 and the I-129 and G 325a's. Hopefully they are all consistent.

 

When discussing Chinese names it is better to refer to "family name" instead of "last name" because the family name actually is spoken and appears in writing, "first". The "given name" is almost always a single name that requires one or more characters to write. The Chinese do not generally have middle names.

 

Unless your wife received a social security number when residing in the USA at some earlier date, she doesn't have one. If you obtained an ITIN for her to list her as a dependant on your taxes, that is not an SSN.

 

Your drivers license would be one way but you want to show proof that you and the other household members ALL live at the same address, so official documents that show the same address for all of you are needed. The other household members' driver's licenses and utility bills would be good. If your cell phone bill comes to your parents address, I would use that too.

Just a little follow up. Your residence and the household member's residence should be the same, so the proof would be aimed at that. The tax return would also be a good indicator.

 

If I recall from another post, you said your SO did receive a social security number/card when she was previously in the US. Personally, I would be very reluctant to leave that question blank. In addition to being accurate, it might also provide a differentiating piece of information when it comes to namechecks.

This is extremely important. If your wife DOES have a Social Security Number, not an ITIN, then you should absolutely give it when asked.

 

You will also be answering other questions differently from most of us because your wife has already been in the USA legally.

Further followup...

 

Her americanized display of her name is whatever YOU TWO want it to be. all we can do is give you some options. Sometimes when the paperwork is inconsistent or not clear enough, it gets put onto the case as USCIS/DOS sees fit. Once she gets to the US, you can control the marriage certificate, AOS petition, etc.

 

I'd follow frank's advice on the SSN... I don't think you want them to overlook an already issued SSN.

 

If you want answers on the I-864, you should call NBC and ask for an AOS specialist... that is the person with [what should be] the correct answers...
