IR1 visa?

On 001, I heard if you first enter into the US custom after you get married for 2 years, even thoug the visa you hold is CR1, you can ask visa officer at the custom to get IR1. But I also some ladies successfuly got it, some didnt. Does anyone know how the percentage getting IR1 is?? I read immigration law but cant find it in details. Maybe my english is too limited to read law provisions. My interview date is 40 days earlier than my 2 years marriage anniversay. I am scared of dealing with immigration again, besides if I move the US in summer vacation, I can still get few months salary here. Any response will be more than welcomed
