Don is correct. My first wife is from Japan. She came over here on a tourist visa in 1979 to visit me and we decided after she got here that the fiance visa route was too cumbersome so we got married then instead. The IO didn't like it much but he approved our AOS.

It is referred to "as a gross violation of immigration laws" for someone to come here on a tourist, buisness,.......visa, then marry.  I believe I also read on the uscis site, that no filing for a immagration visa may apply for any other type of visa.

Marriages are governed by local laws (I believe state). One example of a non-immigrant being allowed to marry is the K-1 visa.

 

I work with a number of Chinese people who came over on temporary (student or spouse of student) visas, changed to an immigrant (work) visa, and ultimately were granted citizenship, all without having to return to China.
