Here's a question for the K3 vs CR1 experts.. 

 

I read on VJ that once your I-130 petition is approved you cannot submit the I-129F .. that seems absurd to me...   Anyone know if you can submit after approval ?

It is written in the Federal Register that if the I-130 reaches post before the I-129F then the I-130 will take precedence over the I-129F. If the I-130 reaches post after the I-129F, the petitioner/beneficiary can drop the I-129F or they can continue the I-129F for the K3 visa.

One could submit the I-129F , say late in the game.. and just hope it quickly gets to post and only then could you utilize it, yes?

I only stated what's written in the Federal Register concerning the K3 visa and it doesn't mention anything about being prohibited. One has to think about what a K3 visa is and what it is for.

On VJ, they are telling people outright, you are not allowed to file for the I-129F petition once the I-130 is approved.. They did not go as far as mention whether at post or not.. but I that is next step..

Can anyone explain the logic of this question between the I-129f and I-130?  why does the I-129f seem to rock and roll, while the I-130 sleeps?

Depends on where you file ;) Anything through Vermont Rocks 129 or 130 :wub: It is the rest of the Service Centers that are very unpredictable, when I started all of this it was unheard of to get an I-130 in two or three months and K Visas were the only way to go that changed and now it seems to be swinging back the other way :P

Is it official, did I screw up by not sending in the 129f after learning about K3. I checked yesterday as usuall.  CSC updated, wow twice in two weeks!  129f jumped ahead almost a month.

 

When I started this, CSC I130 feb14. 129f only a few days ahead.  Two weeks went by, they both moved forward about 4 days.  Two more weeks, I-130 moved to Feb. 28.  129f still a few days ahead.

 

Then nothing for two months. By now I found out about K3.  Made an educated dicision not to file 129f. Now as of last two weeks, I-130 moved ahead 1 week.  129f moving extremly fast.

 

Two weeks ago, 129f moved ahead of when I could have sent one in. Now I wonder if I should just send one in.  They are processing cases they recieved just over 1 month ago.

 

PS

Where can I line up for several of those mop slaps?

May IR1 Petition Beneficiaries Opt for K3 Processing?

30. According to the LIFE Act, a K3 visa may be issued

when "an immigrant visa is not immediately available to

the alien." To maximize the number of aliens who may

benefit from the LIFE Act provisions, VO has determined

that an immigrant visa is "available" only when the actual

approved I-130 petition has been received by the IV-

issuing consular post. If the I-130 petition is at post,

or the applicant has already been interviewed and denied

the IR1 by a consular officer, perhaps due to lack of the

I-864 AOS, that applicant must proceed with IR1 processing

and may not choose to apply instead for the K3. If the I-

130 petition remains at or is in transit from NVC, or the

applicant has already commenced K3 application (by

returning Packet 3 forms) when the I-130 petition arrives

at post, he/she may continue to process the K3 rather than

switch to IR1 processing. K3 applicants may opt at any

time to process as IR1s rather than continue the K3

application.

I am still anxiously waiting for my responce from my so beloved President :rolleyes: I know he will answer my e-mail with wonderfull news :ph34r: About how he and his think tank figured out how do do right by tax paying US Citizens, and learn how to turn illeagals away.

I think filing the K3 in addition to the CR-1 was beneficial for us. Last year, the CR-1 was moving faster at VCS than the K3 process. We ran into a four month delay with the CR-1 and the K3 actually moved ahead. The K3 package 3 arrived at GZ about a month ahead of the CR-1. After both the K3 and CR-1 were at the consulate, I contacted GZ and asked them if they would proceed with only the CR-1 now? They said they would drop the K3 and proceed with the CR-1. I am not absolutely sure, but I think them having the K3 a month sooner saved about a month on my wife's interview date. I have a feeling they were doing some preliminary work on her K3 when the CR1 arrived from the NVC. I suspect, if we had just filed for the CR-1, she would still be waiting for her interview date.

For me, The CR-1 is happening now, as I am at the NVC and expect to have my case sent to GUZ in few weeks......... or should I??

Based on where I am in my timeline.... what is your best guess for NVC to ship my documents to GUZ?
