134 form for K1 do i need to include W2's?

good distinct to make for the I-134.. I think the income tax forms requirements for the I-864 have fallen into the I-134 realm for some reason.. just as the 125% issue has.

 

In fact, for the I-134, only 100% of poverty level is needed to be covered for I-134...

David, OF-167(Rev. 6-91) that goes out in P3 gets fairly specific about the evidence they require for the I-134, it's an oldy but a goodie. :D

 

The wording is vague enough and could be interpreted to include the W-2. This is also where getting the tax form notarized comes from.

Where does it read on the OF-167 that all these are "required?"

The only keywords I read about attachments of evidence are "should" and "substantiate."

 

If one has a steady job than a letter of employment "should" suffice, however, don't take any chances and do include a copy of the latest tax return, minus the w-2. Or, as mentioned already, use the "kitchen sink method." Wherever one's comfort zone lies, or to put it bluntly, " whatever floats yur boat!"... :P

I stated earlier the same conclusion about the employment based on the wording I read... but I do think we can get caught mincing words a little too. So I'll mince some more...

 

Here's my general read of OF-167, which seems to support the idea that a I-134 is not needed at all, and probably expected only for a friend or relative who is trying to help:

 

The OF-167 states the requirement in the first two paragraphs, that the applicant must establish to the satisfation of the CO that they will not become a public charge via:

1) Personal funds (bank statements, assets,etc)

2) Income (employment letter)

3) Help from family and friends (they act as a sponsor and use I-134)

4) Combination of the above

 

Again, the CO can 'request' anything to help meet their statisfaction level... and this would include asking for a I-134 if they deemed it necessary... as the 9 FAM comments below show.

b. K-1 and K-3 applicants are subject to INA 212(a)(4) and must

Applicants may submit a letter from the petitioner's employer or evidence that they will be self-supporting. The Form I-134, Affidavit of Support, may be required when the consular officer deems it useful.

100% agreed... it only explains why people can get a visa without having been asked for it...
