I think the income tax forms requirements for the I-864 have fallen into the I-134 realm for some reason.. just as the 125% issue has. The wording is vague enough and could be interpreted to include the W-2. So I'll mince some more... Here's my general read of OF-167, which seems to support the idea that a I-134 is not needed at all, and probably expected only for a friend or relative who is trying to help: The OF-167 states the requirement in the first two paragraphs, that the applicant must establish to the satisfation of the CO that they will not become a public charge via:1) Personal funds (bank statements, assets,etc)2) Income (employment letter)3) Help from family and friends (they act as a sponsor and use I-134)4) Combination of the above Again, the CO can 'request' anything to help meet their statisfaction level... and this would include asking for a I-134 if they deemed it necessary... as the 9 FAM comments below show. 9 FAM 41.81 N4 Documentary Requirementshttp://foia.state.gov/masterdocs/09fam/0941081N.pdf b. K-1 and K-3 applicants are subject to INA 212(a)(4) and mustdemonstrate to the consular officer's satisfaction that they will not become a public charge.
