  2. Hi everyone, Here is my situation. My wife is here on a K-3 visa and we have submitted the paperwork for the AOS and the work permit. We received a pink slip stating that we are below the poverty line and that we need to submit further information reguarding my finanatial situation or get a joint sponsor. I make over 40,000 a year with my job and have a good amount of money in the bank as well as own a house. My income for my taxes was very low last year because I was living in China with my wife before heading to the US and filing the paperwork. So my guess is they looked at the previous years taxes and disreguarded the pay stubs for 2008 as well as the employment letter and considered me below the poverty line. Should I just get a Joint sponsor or send this years taxes with bank and other financial information to try to get it done on my own? Also I wanted to know if once you submit the information, is it the end all and they either accept or deny you? Or will they send a request for further information as they did before. I wanted some other opinions before I committed to one course of action. Thanks
  3. Hi Everyone, This may be a stupid question but just making sure. I am filing AOS on behalf of my wife and we are expecting a child in March. Should I add our unborn child as a dependant on the I-864? Thanks
  4. We arrived at the Embassy at 6:50 am but my wife did not get inteviewed until about 12:30. It was a long and agonizing wait for me but it doesn't matter now because we got PINK!!! I prepared lots of stuff for the Interview but the VO (23) only looked at our pictures and nothing else. The interview went something like this: 1)Where did you learn English? He was impressed with my wifes English so it was his first question. 2)My wife offered my letter to the VO and he looked over it briefly.Does your husband speak Chinese? Very little my wife said. 3.)Where did you meet your husband? 4.) When did you get married 5) How many times did he visit you after and before you got married? My wife replied that I was living with her for the last year and a half. VO didn't seem to know this. 6)Can I see your pictures? Tried to trick her by saying Fiance instead of husband but my wife corrected him. 7)When is you husbands birthday? How old is he?How old are you? 8)My wife told him that I had been living in China and because of that had a joint sponsor because she said wasn't looking very happy so she offered information. Who is the Joint sponsor? 9)Did his parents come to China to visit you? 10) What is your plan when you get to the US? 11) Approved My wife thought he was very nice but she said that VO 22 was very rigid and often game two white slips that she saw. He also kept a woman there for an hour. Our vo also gave two white slips but my wife said that they were not answering his questions directly sort of beating around the bush. There was an over 80% pass rate during the day from what we noticed, can't be comletely sure though. All of the people my wife talked to while waiting got pink except for one, so it was a good day for everyone.
  5. I have filed Cr1 and K3 The CR1 was filed in October of 2006 and the K3 was sent in December of 2006 Since I filed the K3 does that mean that my CR1 was suspended in order to process the K3? What's the point of K3 then because our K3 has taken longer than a year for us so it really doesn't seem to have any advantage. If so, is there a fee that I have to pay to restart the CR1?
  6. I talked to my lawyer the other day and she told me that I don't have to give them my recent tax forms if it is before the April deadline. I am not sure she is correct but I think I am safer if I do provide this years tax returns no matter what. I am living in China currently but we wanted to be together during the process. Once we get the visa we are moving to the US.
  7. I was in the US when I filed and didn't have any definite plans for moving to China just yet. Direct consular filing would have been a good option for me if I had definite plans but we decided just to file from the US. I realized in China how much faster it would have been if I filed directly in China. Oh well
  8. Thanks for the help! I have filled out both sets of forms as well as my parents and supplied tax forms for each of the past three years. I have also included bank statments and assets to my I-134 because I had no income in the US for 2007. We are in the process of filing taxes for 2007 but I am not sure I will have them in time for the interview. I guess it is possible they could give me a blue slip if I don't have them but it is easy enough once they are done to submit the additional materials. I think we are in good shape, but you never know.
  9. I have the amounts for 2005 and 2004 written on the I-134 and have included the 2006 statement and W-2s. We have also submitted the three tax returns for my parents as well. So I think I am covered. Still a little confused though about bringing the 864 or the 134 to the interview. k3 is a non-immegrent visa so I believe that is the one that they wiil be looking at.
  10. Here is my situation: I am in the process of gathering all of the documents for the Interview. Everything has been covered except for the Affidavit. We filed for the k3 visa so I know that I will finish the I-134 for the interview. I also prepared the I-864 just in case. I am currently living in China so I can only include my tax returns and W-2s for 2006, that income is over the poverty guidline. I also included my parents as a co-sponser because of my situation. Since I have not been in the US for the past year and will not file taxes I am worried that they will deny our case because I have not been working in the US and have not recorded income. I Have been working in China but I cannot include that income with my case. I have about 15,000 in the bank in the US and have a mortgage on a house with my brother. Do both my parents and I have to fill out the I-134 if I want to use them as a co-sonser? If so, do both of my parents have to sign the Affidavit? Is there anything else I can include to make it a stronger case? How much scrutiny does the I-134 usually get for k-3?
