  1. My wife lost her passport and K3 visa while visiting back in China. It's been a nightware trip, but she will be back on Wed. after 7 weeks.

     

    Here is some tips of what to do:

     

    1. get the new passport at Beijing if you lost it there. my wife went to her hometown and it will take longer.

     

    2. go to the DHS office at Beijing and they are the one take care of this kind of cases, but even some of embassy officers don't know about it. they will issue her transportion letter in order to get her back to the state and wait for the green card.

     

    3. take good care of your visa and passport!! don't lose it!!

  2. we talked with both the embassy and the immigration office in Beijing. Beijing turned her case down and told her to go to GZ (final decision).

     

    Somehow, she managed to reach the DHS office in GZ. so far, they are still investigate her case (been a week now). If the DHS won't handle her case, they only way is to get the package #3 and reapply for the K3 visa.

     

    btw, since her I-130 is approved already, how long does it to take to get her green card if apply it in GZ?

  3. Thank you so much for all you help. The link is very helpful. I talked to a immigration lawyer this morning and he won't even accept my case. :rolleyes:

     

    Also, the link says "you must apply in person at the Embassy or Consulate abroad for a new visa." hopefully, it won't take another 10 month.

     

    to make the situation worse, I received a notice from Atlanta office today saying my wife's fingerprint is about to expire. The new fingerprint appointment scheduled on 06/11. I checked the Atlanta process data, the AOS date is 06/30/2003 now, just one and half month till the date we appied the AOS. :blink: :ph34r:

    My wife lost her passport and K3 visa at Beijing airport. She's going back to visit her parents. It's been 3 weeks now and she already got her new passport, but she can't come back without the visa!!

     

    We contacted the GuangZhou immigration office, but couldn't get a firm answer about how to process this case and what can we do. One option they suggest is redo the K3 visa, my god, it will take another 10 month!!

     

    We already filed the I-130 (approved) and I-485 (still in process) at Atlanta office. I shouldn't listen to her and let her go back. To make it worse, her K3 visa will expire on 25th this month.

     

    I am open to suggestions. Please help!!

  5. I agree with tonyontherock. I don't have problem with those illegal immigrants, but please don't drive the car on our road. In Alabama, it's illegal to drive the car without the insurance, but since they are illegal already... :angry:

     

    I heard Atlanta are started to act on this and i guess that's why they are moving into AL now.

  6. we had a car accident on Sunday and it's first time for both my wife and me in a hit&run situation. the good thing is we are ok and the guy is caught by police after 20 min. the guy is illegal immigrant from Mexico, no driver's licence, no SSN, no insurance.

     

    and today we got a letter from BCIS saying we didn't include the copy of my wife's K visa. we are sure we did it, otherwise they won't deposit our check 2 month ago. anyway... :( :lol:

    we are at the same situation as you are.  we went to the local SSA office and the lady told us my wife has to have the EDA in order to get her the SSN.  we applied it about a month ago, but still no news...

  8. I mailed out the I-765 for my wife's work permit two weeks ago, but didn't receive any receipt or NOA from the BCIS yet. Also, they didn't cash my check. I am wondering how long it will take for them to send a recept back for this kind of case. I remember when i file for I-130, I got a NOA back within one week.

     

    Also, do i need to fingerprint for I-765 before I file it?

  9. eric/yuhui is confusing the I-134 with the I-130.

     

    and yes, you can file the I-485 before the I-130 is approved. the BCIS lady is confused.

    'If you are the immediate relative  (spouse, parent or unmarried child under 21 years old) of a U.S. citizen, submit the following forms:

     

    Either your original I-130, Petition for Alien Relative (if you are filing concurrently), or a copy of your I-797, Notice of Action (if the petition was already approved).'

     

     

    They wouldn't have BOTH options unless you could file before the I-130 was approved ... not to mention it can be years before approval now ...

    since i already filed I-130, i can't use the first option; then I-130 is not been approved yet, so i can't use the second option...

     

    does that mean i can not file the I-485???
