So , it turned out that Suzhou custom has the parcel and they sent out a notice to the recipient, my father in-law yesterday and He has to go to the post office at Suzhou and go with the employee to the custom there to claim the package. According to the new regulations of the china custom, any product or package that is worth more than 400 yuan (chinese currency) will be suject to china custom inspection and a duty will be determined. I wrote down 80 dollars for the gift I included in the package, and it was therefore handed over to the closest custom to the recipents home address. lesson learned

  2. Hi all

    Just wondering how long it would take to clear custom in china. We've sent a parcel with the original docs to the in laws for their upcoming interview. It was being processied by the custom since the 12th of this month. I sent expresses with USPS. They should have gotten on 14th Monday. If for some reason it got held up. We have to resend the docs. Now. We ve already sent the original copy of our marriage certificate and my wife s birth certificates in the previous parcel. Luckily we kept copies of them but not the original. Do u think that Guangzhou embassy consulate will accept that if they don't get the original Please share your similar experience. Thank you. If we know that sending a gift along with the original docs would be held up at custom we would nt have sent the gift. Just the docs only.

    I am actually going through the same process of getting my wife's parents to come over. My situation is as followed:

     

    Their petitions have been approved and sent to nvc and I've received the emailed aos bill last week with the attached ds 3032 forms.

     

    I haven't optin for eprocessing yet. But want to. At this point. What I have done is :

     

    I have the in laws emailed nvc for the choice of agent ( about a week ago, no response except for the auto one) and I paid the aos fees online. Still waiting for the iv fees to be generated. When should I expect the iv fee to be generated from nvc? I am in the process of collecting document for the affidavit of support. Should I wait till nvc generate the iv fee ans pay it ans then send the aos ans iv application together or should I send aos first?

     

    At this point. Can I still optin for eprocessing cos I still haven't sent anything yet except for paying thr aos fee and have them emailed the choice of agent. How long will it take for nvc to respond to the optin email and choice of agent email.

    I really want to expedite this process so that they will come here at the end of this year. Thank you so much in advance for your advice

     

     

    If you could point me in the right direction with their current situation. I will greatly appreciate your help. Please pm me if you need additional info. Thank you again.

  4. OK,does an I-864 from us need to accompany their visit visa application (sent to embassy in Beijing(?) ),if we go that route? Btw,thankyou very much for bearing with we here dnoblett,as I seem to be getting conflicting procedures thruoghout the web (or maybe my comprehension).I tend to think it's better to go the I-130,DS-230,I-864 route,but SO is worried about the trip to Guangzhou from Beijing (affects and parents) coupled with the ability of one or both of us to accompany them.

     

    This is how the normal state side process for I-130 works, Beijing is not involved at any stage.

    1. Petitioner mails an I-130 to USCIS office in the USA mail address changes SEE: http://www.uscis.gov...00045f3d6a1RCRD
    2. I-130 is approved and UCIS sends it to NVC
    3. NVC informs petitioner of assigned case number
    4. Petitioner can email NVC with case number to opt in to eProcess,
    5. I-864 is sent to NVC along with processing fee
    6. Beneficiary sends Choice of agent to NVC designating petitioner to handle sending further papers toNVC
    7. Beneficiary sends DS-230 along with other requested docs to NVC
    8. Payment is made to NVC
    9. NVC sends case to Guangzhou and schedules interview
    10. Interview happens in Guangzhou (If opted for the quicker e-Process at NVC all docs that were scanned and emailed to NVC need to be brought to the consulate when interviewing.

    Petitioner can travel to China and accompany beneficiary to the consulate in Guangzhou however cannot actually be in the interview, petitioner will wait outside the consulate.

    so...their notorized translated marriage certificate is the only document that they need to get right? since my wife already has her birth certificate with her. What about the criminal free certificate?...do they get it when they are notified for the interview?...

    Wife just got sworn in as a citizen and wanted to petiton her parents to come here. now I have a dilema. She wants to get her parents tourist visas while the petitions are in process. Is there gonna be any conflict and will they be denied because of the petitions are in process? or should we get them the tourist visas first and have them come here and put in the petition and wait out the process and do an adjustment of status. I guess my question is: do they have to go back to China for the visa interview if their petitions got approved while they are here on a tourist visas or can they just wait out the the process here and get interview here for their green cards. She wants them to be here first and start the petitions. If the process takes longer than the visas allow them to, can they extend or renew the visas and wait for their green card?....

     

    what will be the best approach to bring them here?...

     

    Any help will be appreicated ...

    Wife will become citizen in the next couple weeks. She wants to petition her parents to come here. I just went through the I-130 form and notice that it doesn't seem to require as much relationship supportive documents as I did for my wife. I am just wondering if I am missing any documents to prove their relative relationship.

     

    On the instruction form.

     

    it only tells me to send copy of her birth certificate and her parents marriage certificates

     

    it doesn't ask for pictures, letters, of to fill out any g-325 for each of her parents.

     

     

    is this true that that's all i we have to send with the petition application?

     

    Please help if i am missing anything here.

  8. No. She does not need a visa to go back to her own country. She will be able to get in with her chinese passport and come back with her GC. Unless she tends to stay there for more than a year, then she would have to apply for a reentry permit ( good for two years) to come back to the u.s. If she only stays there for a few month. then she is all set. hope this helps.

    just wanted to know the process for petitioning the in-laws to come here. Wife just passed her citizenship interview. I understand on the day she takes the oathe, she will be able to start the petition process. Here is the question. Once you start the petition application, could her parents still obtain the tourist visa to come vist during the process? or she could get her parents visa to come to vist and then start the petition process and have them wait here ? I guess my question is , can she start the petition while they are here on a tourist visa and wait out the process or she could start the process here while they are here and have them go back to china for the interview or they can stay here for the intervew?....Please help clear up these confusion for me. appreicaite any help.

    Just wanted to know what the process will be like for a 2nd time tourist visa for the in-laws after they returned to china. Do they have to apply like they did the first time exactly, or is there some slightly different procedures since they have been granted a visa before? It's been a year since they last visited the united states. Actually, they have been visited here twice with the same visa since it was good for a year. They came here the 2nd time before it was expired. Now, they wanted to come again. Are they gonna be running in trouble at the interview if they come 3 times within two years? They never overstayed here for the 1st and 2nd time. Any advices will be greated appreciated.

  11. Where do your in-laws live? Guz is so corrupted man.

    I think it also depends on the region that you live in China. If you live in a high income area, then the chance of getting approved is very high. My in-laws went through the interview in 5 mins and only a few questions were asked. It took me a lot longer to prepare the application and documentation for them. They are also both retired and my wife is the only child. btw, They are from the shanghai area. I was told by my wife that people in that area don't want to come to the u.s at all. Life there is much more exciting than it is here.

     

    The In-laws own two houses. They have two other daughters with two son-in-laws and two grandchildren. They each have their own, very small retirement income.

     

    If your collecting anecdotal data, as my wife and I do, I'm sure you'll find that any body still working in any professional job will get a visa. Anybody who retired from the government or a big business and has the luxury of a 'large' income will get a visa.

     

    This year, at the Grand Canyon, we met a couple with 2 kids who got a visa so they could come and travel with the one high school age kid who was here in summer camp. No invitation from anybody. Oh, yes, they both still work at good jobs. Also at the Grand Canyon we met several College age girls who came here to visit.... my wife talked to them at length. There was a group of them. They apparently all applied as a 'group' but without any formal tour or tour guide.

     

  12. Its completely up to the POE officer.

     

    They will talk to you about your reason for visiting and grant you anywhere UP TO 6 months. The first time my girlfriend visited they gave her 6 months without even asking but another time she came to the U.S. for a week long conference and they only gave her a week! Ya never know unfortunately. Since they often want to see a return ticket booked, they will set the duration consistent with the return flight.

I dont think it states on the visa how long you can stay. it only states the period of validity of the visa, which is the the expiration of the visa. they went back about six weeks ago. becos of family emergency..we need them to come back here to help out with the family....is there a way you can check or ask how long they can stay when they return the 2nd time?....i am afraid at the poe they are gonna be asked why they are coming back so soon and what's the purpose of this trip.. and that determines how long they will be allowed to stay in the u.s....am i making any sense....we need them to stay for at least 5 or 6 month....

  14. so, my in-laws were issued multi-entry b2 visa and they came and returned back to china. My question is : since it's a multi-entry visa...that means you can come in multiple times before it expires, does anyone know how long will be allowed to stay when they enter the 2nd time?..first time when they came...they were allowed to stay for 6 months....Any help will be appreciated...

  15. The exit stamp in your passport is proof that you exited the country and that it was recorded.

     

     

     

    thank you all for the information. I don't know if they stamp your passport when you exit the country....at least not on the U.S passport....I'll have them check with the airline before they board....

  16. You need to make sure and get the I-94 arrival/departure form back to DHS. Otherwise you can have very big problems if you ever want to visit the US again.

     

    What If No One Takes Your I-94 Form Upon Departure Failure to turn in your I-94 (or I-94W) when you leave the U.S. can create a serious problem. Without this record of your departure, you will be identified in our records as an "overstay." Being identified as an overstay means that you will be denied re-entry into the U.S. If you failed to turn in your I-94, please send it - along with any documentation that proves you left the U.S. to ACS Inc. 1084 South Laurel Rd., London, Kentucky 40744.

     

    Documentation to prove your departure can include the boarding pass from your flight. If you exited the country by a land border it is much harder to verify that you did- in fact - leave the country on the date you claim. If you have any documentation of your arrival in your home country (i.e. passport stamp), then you should send a copy of that. If the above office does not have any supporting documents to substantiate your claim to have left the U.S. on a certain date, there is no guarantee that you will be entered into the record as having done so. We strongly urge you to keep a copy of what you send to ACS Inc. and to carry it with you the next time you come to the U.S. in case the CBP officer has any questions about your eligibility to enter.

     

    If you want to confirm that your I-94 was received by ACS, please give them 4 months to process the paperwork. Then you can write the following address to determine whether or not your departure was recorded. If you turned in the I-94 when you left the U.S. as required, please do NOT request confirmation that it is on file. This process is only for people who did not turn in the I-94 when they exited the U.S.

     

    You will need to provide your name, date of birth, passport number, and date of departure, in addition to asking whether or not your departure was recorded. U.S. Customs and Border Protection Air Sea Passenger Operations, Room 5.4D, 1300 Pennsylvania Ave., N.W., Washington D.C. 20229.

     

     

    Here links with some information about returning the form and what to do if you get home with the form in your passport. As you see, this can be a big problem for even Canadian citizens, so it is very important DHS gets this form back in a timely fashion.

    "If you departed by a commercial air or sea carrier (airlines or cruise ships), your departure from the U.S. can be independently verified, and it is not necessary to take any further action, although holding on to your outbound (from the U.S.) boarding pass - if you still have it - can help expedite your re-entry next time you come back to the United States."

     

    That means my parents - in law don't have to do anything about the I-94 right? thank you...

    My parents -in law will be leaving soon .going back to china...are they supposed to turn in the I-94 card at the airport when they leave.. Where would they turn it in, because you don't have to go through immigration or custom when you leave the country...any help would be greatly appreciated...

  18. which consulate did you go to? the one in GZ? My in laws got here from Shanghai a month and half ago. They were asked a few questions only and none of the documents i provided for them was looked at and they got their visas. (Shanghai consulate). It seems that everything in GZ consulate is more complicated and harder to get a visa ( any kinda visas). Just keep trying buddy and maybe you ll get a kind VO in a good mood.

  19. Let's throw something out for general opinion from anyone and everyone.

     

    A couple gets whited for a K1, for not a bone fide relationship, and while the petition is in the full return process, the couple marries and then starts a new K3 petition.

     

    If having never received the NOID/NOIR letter, listing the specific reason(s) for denial, so not being able to rebut directly, what is everyone's opinion on:

     

    if the K3 petition is approved by USCIS and the NVC with the reasons known to them for the K1 denial, and they STILL approve for the K3, GUZ not being able to cite these reasons again at the K3 interview? They shouldn't (I shudder at that word) be able to cite these reasons again if the K3 petition's been approved by USCIS and the NVC with them knowing GUZ's original reasons for denial?

     

    did we know if anyone get denied on his second try?.....i think we need statistics then we can draw conclusion of how to proceed if denied the first time. getting married on the second try is certainly part of proving to GUZ " bonafide" and then, time and visits are also some of the most important factors too. IMO, no rush is needed in the second try and as cliche as it is... time will prove everything..bonafide or not....time is the best witness in this whole process.......

  20. Who should do the I-134? Me or my wife. We both have jobs, and joint tax return.

     

    When my parents went for their interview last summer, neither my husband nor myself have steady jobs. We didn't provide any I-134.

     

    My parents took family photos, my sister's employer letter (to show her job in China and income), my parents' owner certificates of their apartments, their bank account information, etc.

     

    I provided an invitation letter, evidence of the relationship, copy of my green card, marriage certificate, things like that.

     

    how long would the petition process take?....my wife is expecting in this august...and it would be nice if her parents come and visit us during or right after her delivery....what kinds of tourist visa would they be under?....i am guessing B-2 right?....is there a link or thread where i can follow the steps exactly for this application?.....thanks in advance for any help and suggestions.....

  21. There is a form to fill out to let them know you have a SSN. I was told this when i was on a visit to their office recently. We were told my wife was not in system (although we had already sent in amended taxes w/ new SSN) and went downstairs to Social Security and they printed out a statement that verified she had a SSN. Brought it back upstairs and IRS updated the file.

     

    my question is, DO YOU HAVE TO LET IRS KNOW AND HAVE THEM UPDATE IT?...SHOULDN'T IT BE AUTOMATICALLY UPDATED WHEN YOU FILE YOUR TAX THIS YEAR?....
