  1. Sounds like it's a typo, and you need to get it fixed. Otherwise, the fingerprints may not show up in your file. InfoPass appointment time?

    how retarded are these people?

I don't really think you want to know. This morning I scheduled another infopass....nothing else I can do now that so many have been getting AOS interview notices while Ling and I sit here on our thumbs watching the months go by.

  2. Never mind Curt. You are so much smarter than everyone else you figure it out.

That comment is completely uncalled for. But I'm glad to know what you really think about me. Thank you.

You keep saying it inspite of the info offered by myself and another to the contrary. Asking why you've completely disregarded that info is a legitimate question.

A Schedule C is not a higher burden of proof as it is already part of the tax return of a self-employed individual.

Unlike a self-employed person, an individual employed by another must submit a letter of employment. That sounds to me like the employed person has the higher burden of proof.

Why does my pointing this out and asking for clarification bother you so much??????

  3. The burden of proof is a little higher for self employed. If you work from someone else you need only include a copy of your federal tax return and W-2 showing your gross income. Deductions or expenses have no bearing on whether you qualify or not.

Why do you keep saying this? What is this "little higher" consist of??????

  4. And by putting in 0 it shows you have 0 income before deductions so you must prove income by other means. I swear Curt you like to argue over anything. I was merely pointing out that showing income for self employed is a little different than folks that work for someone.

    It's called a Schedule C Carl.

No I'm not arguing about nothing. You provide a copy of your tax return whether you're employed by another or yourself. It's the same. In fact, it's a bit easier because my Schedule C supercedes the need for a letter of employment that the rest of you might need to provide.

Your statement said self-employed have to prove income by other means and it just so happens that we don't.

  5. It's a little different for the self employed. They don't have W-2 forms. They have to prove income differently or show sufficient assets.

As a cautionary note I would not recomment that those of you going through the process use Jim's method.

Us self-employed just provide copies of our tax returns like everyone else.

I see, and on the line in the tax form where it says income from line X on your W-2, what do you put?

    0

  7. Just wait for EAD. It takes about 60 days.

Honestly I like having Yanlan around the house, she is a lot of fun. SHE is the one that can't wait to work. I need jobs. is all I hear. I try to tell her to slow down but to no avail! :P

Then maybe you'll be fortunate like us and have to wait 120 days and counting.......

Yes, Ling has been making noises for a week now about working without a work permit. I've told her that breaking the law in that way is NOT an option in my household. Yesterday she came home from her ESL class (what a great venue for spreading misinformation!!!!) claiming knowledge of all kinds of work it is legal to do without a permit.

Ling told me she needed to work so she could help pay for our food. I only said, "yes....and our house payment......"

She replied, "but that is $1200 every month!"

To which I responded, "but you only have to pay 1/2. And when your daughter gets here you will pay 2/3."

She knows I was only teasing but I made my point. She promised me she would wait for her permit.

  8. It shouldn't be any problem if she can produce the EAD card within 90 days (she can).

But the company isn't required to allow her to work. If you still want to try, show them the NOA1 from the EAD application.

Randy we gave them all the reciepts and everything. No luck.

    Thanks

Because an application doesn't guarantee approval. We're waiting onboard the same boat--almost a full month ahead of you. 90-day window expired and no EAD in sight. Don't sprain anything twiddling your thumbs waiting.......

  9. Well, this morning we had our infopass interview. To make a long story short we were informed that yes indeed, the two previous issues (RFE for information already provided and mistaken change of address) have caused our official "application received" date for Ling's I-485 to now have been posted as August 15 rather than the May 9th date they officially "received" our paperwork.

As for the I-765, she said that someone had made an error in the computer and tied the I-765 (EAD temporary work permit) processing to our I-485. According to our interviewer, this means that unless we had come in, the I-765 would not have been processed or completed until our I-485 AOS was completed! WTF???

Yes, folks, another random and total f-up by the good people at NBC. I asked her how often these kinds of completely off-the-wall screw-ups occur and she only replied, "they do."

Anyhow, she called NBC and supposedly got the I-765 mistake fixed and moved into "expedited service." She said we should be receiving the EAD "within a couple weeks." I will hope she's right but I'm not going to be holding my breath........

  10. I filed K-1 for my Ying and her daughter. We just sent P-3 back today. Our daughter (18yo) no longer wants to come because she has been accepted to Shanghai music college although she might want to come at a later date. Because she does not speak English well she thinks her best option is to stay in China for now and attend this college.

Is this going to upset our K-1 visa at interview time?

Nope. Just let the paperwork continue as is and the daughter just doesn't need to come to the interview.

This is what we did last winter. Because our daughter's name was on the paperwork all the way through, this summer when we were ready for her daughter to follow, we just emailed GZ and asked for a new interview date for her. Yesterday she received her interview appt letter.

This way, for up to one year after your fiancee's interview, her daughter can still change her mind and reactivate the K2.
