My SO's interview date for our K1 is August 28.  We have prepared the best that we can but I can't help but be nervous after reading all of the "things that can go wrong" in CFL.  I have been married several times with my last divorce finalized March 18, 2005.  My first visit to her was in Feb of 2005.  I had started my divorce papers before I met my wonderful SO.  Explaining this to her was very difficult...lol....but she finally understood.  We have known each other now 1 year and 9 months.  It took me a long time for her to understand my past marriages but she was patient as I told her the truth.  I understand that there is a possibility that the VO might want my ex's ss#.  I do not have this and I know I will never get it from her.  I haven't spoken with her since the divorce. 

    I can only pray at this point that all will go well the 28th.  I could use a few prayers from everyone else, too.  Also, any advice is muchhhhhhhhhh welcome.

    Charles, I wish you the best and hope things go smoothly. Hopefully, they will never ask that question. I have a similar concern whenever I get there. I don't have a clue where my ex wife lives or even if she's still alive. I've been married several times as well. I read somewhere that you can just write a letter explaining that you do not have that information. I don't know if that will work or not. Others here may know how to handle it. Good luck and let us know how it goes. ;)

I noticed that some people have called the DOS to gain the status of their K1 Visa process.  I gave it a shot a few days ago, low and behold, I found why our case has been held up so long from P3 having been returned to the consulate in Guangzhou.  I listed my SO's son on the original I-129F.  The form said to list a child if he might go along with the SO to the United States upon successful acquistion of a K1 Visa.  My SO returned her P3 info on May 2, 2006 and we have been waiting for the P4 to date (August 11, 2006).  The DOS told me that the consulate was still waiting on paperwork for SO's son, that I had to write a notarized letter to the consulate officially removing the son from the case since he cannot join his mother at this time.  If withing one year, yes, however he will have to wait until he's 16 years old, the father won't release him!  Once he is removed from the K1 process, the consulate will proceed.

     

    Met online (cherryblossoms.com) 8-11-03, visited China 1st time on 12-21-04, I-129F application NO1 on 2-15-05, NO2 on 1-28-06, visited China 2nd time on 2-9-06.  SO receives P3 on 4-27-06.  Notarized letter removing son from K1 sent out on 8-11-06.

    When I filed my I-129F I noticed that they wanted information on my SO's children. I called the USCIS and told them that the form did not say to indicate whether the child was coming or not. They told me to attach a letter stating that he was not coming as was the case. I did this but they still kept him on the list. My SO received a call from the GZ visa unit asking her if he was coming. She told them the same thing I told the USCIS in my attached letter that he was in the wardship of his father and could not come. They still have not removed his name when she received her appointment letter. I figure that her son not coming to the interview will finalize the fact that indeed he is not coming. For some reason they do not like to listen when we tell them some things. all we can do is keep telling them I guess. Perhaps they think that one day he might follow and they are keeping him on the list for this reason. Good luck to you. I started my K-1 in April of 05 and my SO has finally received her appointment date of August 28.

  4. We were to pick up the visas Saturday morning;

     

    Making final travel arrangements; spreading the good news; going to a celebration dinner: at 5:30pm Friday evening the Post Office calls and states that the Visas have been denied.  Further background checks are required.  No timeframe is offered.  Come pick up Passports only please.

    There is no end to this NIGHTMARE.  I will return to the states alone; cancel shuttles; concerts; airplane tickets;wedding arrangements for family...on and on.

     

    I would like to take this moment to thank my own United States of America Government on their efficiency in aiding one of there CITIZENS in his simple request to unite with his Fiance who has waited patiently for more than 18 months to satisfy this simple application.  I know that my government is always there "to help me".

    This is totally outrageous!!!!!!!!!! When you come back to the states you need to call your congress rep. My congressman has helped me a lot. They will listen to you.

  5. since these are P4s, they are hand carried to the interview (as opposed to mailed in).  The worse case is they make you fill them out at the consulate.  I've yet to hear this for these forms, but a similar situation happened to someone with some other forms (they re-filled them out).

     

    If it were me, I wouldn't hesitate to use them.. as long as they appear to print decently...

    Hey David,

     

    Makes sense to do this. My fiancee just told me that she talked to Guangzhou about this and they told her that when she comes then she could come early and get a new P4 at the consulate for 600 RMB. Have you heard of this before? Seeing as Guangzhou's website offers the DS-156, 156K, and 157 on their website and does not offer the others then I would think that the VO has full discretion as to the other forms. Your opinion is always most welcome.

    I hope you are not tired of all my questions.  I am almost done for tonight anyway  <_<DS-157 Question 17 says "List all educational institutions you attend or have attend.  Include vocational institutions but not Elementary Schools.   What do they mean by elementary?  Does this mean anything below college level or does this mean just not grade 1-6?

    My fiancee went to one school that was elementary and high school all in the same place. I listed this school and made a note on a seperate piece of paper that this school included elementary and high school. I doubt this will cause a problem.

Has anyone out there had the problems I have had with Guangzhou?  I have told them numerous times that my fiancee's child cannot come to the US as he is in the wardship of his father.  I have given numerous times my fiancee's change of address.  They just can't seem to get this right.  On top of all of this, they sent her packet #4 as an immigration packet instead of the K1 fiancee packet.

    If you have had the same problems then I would like to hear from you.

    Reference the child I have the same problem have been told it is automatic. I didn't file an I-129F, only listed as a child of hers, for my wife's child but she is still scheduled for interview. I even sent Guangzhou an email. My attorney says automatic but the child just won't show up for interview. Questions might arrise but my wife is bringing letter from her daughter as well as the family member she will live with indicating the desire of the child to stay in China and the family is ok to take responsibility to care for her.

    Yes I believe it is automatic. GZ called my fiancee and asked her if her son was coming and she said that her son is in the wardship of his father and can't come but they still listed him on her interview letter. I think it will be fine if he doesn't come to the interview. I know they will ask her again at the interview but she can tell them again that his father has custody and he can't come. I think this will suffice. Thank you so much for you advice:)

    not only because of the mistake they already made but also because

    I am worrying about what if those forms that I have got are the wrong

    one too?! I told my fiance that I really want to go to US consulate

    and take those forms back in person. :violin4: We will write to them now

    and hope they can have time to read our emails tomorrow when they

    go back to work.

    Please try to not feel down. The whole visa process for me started in april 2005 and I am still waiting. I have not made any mistakes with the paperwork but the consulates makes many mistakes. I had to have my senator help me a lot. I also wrote a letter to the USA president and they followed up with a phone call to me. The USA govenment really wants to do good but sometimes their people make many mistakes. I believe they are poorly trained. We need to be smart and patient and look everything they do very closely. There are many good people on this website that have much information. My fiancee's interview date is august 28 so I have time for the gz consulate to correct their mistake. Hang in there, happiness is around the corner:)

    As for the P4, please be specific about what she received that makes you think she has the wrong packet. The K1 Visa IS processed as an immigrant Visa because immigration is intended. She will pay the nonimmigrant visa fee.

     

    The first line of my wife's K3 P4 letter says...

     

    The consulate has scheduled an appoinment for an immigrant visa interview for the beneficiaries as noted at the bottom of this letter.

     

    A later line says...

     

    the interview will take place in the immigrant visa unit at the following location:

     

    The immigrant visa unit processes these visas.

    I'm Mike, but I would expect your fiance's letter to be identical to the one my wife received. The P4 is not different for the K1 and K3.

     

    Everything I wrote applies to K1. The immigrant visa unit will process the visa but she will pay the non-immigrant fee. She will queue in the immigrant visa line outside the Consulate on interview day.

     

    She should have the letter along with the GIV-24, DS-156 and DS -157 suppliment.

    I can't address the intent to marry but are you sure she didn't get the other forms? What DID she receive? So far, we've only determined that the letter seems correct.

    hey Mike, she did not get the other forms. I had her scan and email all documents and the ones i mentioned were not in the packet. I showed her examples of what the forms look like and she said she did not get them. GZ's consulate website tells what she should have received for the K1 p4 and the family based visa p4. The forms she got are consistent with what the website says for a family based immigrant visa but not for the fiancee visa. The forms for the medical and the family history are the same but the K1 is supposed to have supplemental forms included. I think that they sent the wrong packet. I will send them an email and tell them this. I just hope it doesn't cause anymore confusion than is already there.

    The reason I know it is the wrong P4 because there is no ds 156, ds156k, ds157, gni-2, certificate of intent to marry. What she received was nothing like what the k-1 FAQ on the consulate's website says except for the medical forms. She did get the ds230 pt 2 which is not stated on the k1 FAQ but is stated on the immigrant visa FAQ. Am I thinking in the right direction?

  16. USCIS has my fiancee's first name listed as a first and middle name in their system. I checked my original submission and I gave it to them as one name, but nevertheless they have it in their computers incorrectly.  What can I do to get this corrected?

    Good luck with getting anything corrected with the USCIS. However, i doubt that this will cause any problems with your visa.

  17. Welcome to CFL, the only place in town that caters to the GZ consulate weary.

     

    I think it's safe to say that all of these things have happened in the past, though I can't recall it happening to the same person.  I had problems with the address, and others have received the wrong P4.  The child issue is actually fairly common because of the follow to join possibility.  The fact that GZ doesn't do anything about it doesn't seem to cause a problem.  If the child doesn't show up for the interview, it doesn't seem to have any impact of the process.

    Thanks for your reply. Yes all of this is happening to me among many other problems with a delayed USCIS approval. I finally got my senator in on the action and he got me approved. But after all of the confusion, they still haven't told me I have done anything wrong with the paperword. I started all of this in April of 2005 and I am still waiting.

    They keep listing him as a beneficiary for a visa but he can't come. They even called my fiancee and she told them the same thing that he could not come. But they still list him as a beneficiary. I suppose this poses no problem as they will see when he doesn't come to the interview. Thanks for your reply.
