  1. TCPBut how come the consulate want the third party to use the web form. Afterall, she didn't the first time. Why the change? Do they think the third party is been petty or what? Can't understand.

As I mentioned in my TPC posting, the thrid party involved in my KI petition wrote back the embassy to correct whatever negative impression and the consulate replied her that e-mail inquiries to the Immigrant Visa Unit must be submitted through a web form which requires knowledge of some case specific information to ensure that the inquiry is coming from the petitioner or an authorized representative. What baffles me is that the e-mail to the same address she sent the first e-mail to (that lead the our blue slip). What could be wrong? What do I do next. The thrid party is neither the petioner nor the beneficiary hence I'm not comfortable giving out all my SO's personal info for her to fill into the webform. Please advise on what to do. Many thanks.
  4. The consulate replied my e-mail today saying my SO should follow the instructions on her blue slip. I thought they were going to say that I should inform my SO to come for her visa since the third party had already wirtten the consulate eating her words.
  5. No written notice, she was interviewed only 2 weeks ago. She got a blue slip and I have sent the document requested to her. I was asked to make a notarized statement concerning my relationship with the third party which I have already done and sent to my SO. Now that the thrid party has written back withdrawing her correspondences, I just would like to hear from the embassy and know which way forward.
  6. My SO had her KI visa interview about 2 weeks ago. Initially, her visa was proved but was later called by the consulate for another interview (in 2 days) during which she wasn¡¯t issued her visa due to third party correspondence. My SO was told the name of the third party who happen to be my ex-friend. I was so bitter about it and had to confront her. She apologized and said she wrote the embassy out of jealousy and promised to contact the consulate to ignore her correspondences. She told me she¡¯s already done that. On my own part, I wrote the consulate early last week explaining my own side of the story. It¡¯s 5 working days since I wrote the consulate but no response. I¡¯m so worried now because the consulate hasn¡¯t replied me e-mail. What could be wrong? My SO is very worried too. Is there anyone in my kind of situation? If a third party writes back withdrawing his/her statements what happens? If my SO calls the visa information center to book for another interview, in how many days from the date of booking will the interview be scheduled?
  7. Hello, I'm worried. My fiancee's KI was approved on Monday, she arranged for pick up this morning but on getting to the post office, she was told to come back tomorrow. Every other person approved the same day got their visas today. What could be wrong? All efforts to get somebody to talk to at the embassy proved abortive. What do we do?

In a situation where a K1 beneficiary with a child doesn't have a legal child custody; the child's name was included in the petition(I-129F) and the beneficiary indicates that the child will "follow to join" at a later date (probably to allow time to deal with legal child custody). How does this affect the benefiary viz-a-viz their K1 Visa? Put differently, can that be a ground for K1 Visa refusal?
  9. . What would concern me, if I were in your shoes is this. You and your fiance were unprepared for the custody issue. If you have other ommissions, documentation missing or preparation issue, they too will stand on their own merits. If you're confident you are otherwise prepared then I would go in with a positive attitude and hope the VO does not ask for proof of custody. 215986[/snapback] Thanks. I got everything I need except for proof of legal custody of my children. My fiance has visited 3 times, I got enough to prove that we have an on going relationship. The only "but" is child custody which I did't pay attention to until I became a member on this site a couple of days ago. And the embassy is aware that my children are not with me.

I got 3 years residency. And I got all the necessary documents I need for my interview including a Police Certificate. I just wanted to know the effect custody issues have on my KI Visa interview. I'm silent about my country because I'm aware of the fact that this site is for wifes and fiance/fiancee(Chinese) of American citizens. Thanks.
  11. I asked about the ages of your children because it matters. Over a certain age and they must be present for an interview somewhere. Over 18 and you don't need custody. Over 16 and they must have police reports. My kids are 8 and 5.

I'm in a foreign K1 beneficiary in China. I left my country immediately after my divorce. My children are with my parents in my country (not in China). Since I do not have legal custody of my children, can I be denied K1 visa based this? This is what really bothers me. Is the appoval for K1/2 same day even in case of follow to join?
  13. I'm worried because I don't know how this issue is going to affect my interview. I don't know where my ex-husband is and since I'm abroad, I can't file for the custody of the children from here. I only got a divorce decree which talks about the dissolution of the marriage and that child custody would be discussed in the court chambers and since then, nothing was done. My interview is next week and there's hardly anything I can do within this short time span. I need advice on how to put this issue of child custody straight if asked at my interview.
  14. The divorce document says he wants custody of the children. And in the judgement, it says that custody of the children would be discussed in the court chambers. After that, my ex-husband didn't do anything about child custody. He went away and since then the children have been with my parents. Then I left my country for china. I'm a foreign K1 beneficiary China.
