Just an suggestion, if both of you have Skype, use a video recorder to type your conversation online and submit it on a CD or video record you calling you wife on the phone. I remember the blue slip we received stated you can submit video for how you communicate and an attorney I hired said so too, oo that will show how you guys communicate. As you said, make sure you do everything prefect before you sending it in, because they are only giving you one shot. Take you time, I tried to do it too quickly with our blue which I regret after receiving the rejection. Get couple of attorney's suggestion if you can. Everyone here are hoping you can get your blue overturn.

We got the blue the first time we applied for the fiancee visa for pretty much the same things they asked you to submit plus financial records because I had a cosponsor and prove I live in the state. We have the marriage ceremony and wedding pictures and travel records but very little communication records except for a few emails. I thought the hundred or so pictures we submit will prove we had a bona-fide relationship. We submitted everything they requested in detail plus notarized, but at the end, we still got the rejection. You probably know this, from what I understand with your I-130 application, if you get rejected, it will be a world of pain because you have to wait for GUZ to return the application to USCIS for review and wait for a rebuttal, if the USCIS approves it again, it will send back to GUZ, who knows how long that process will that. I went alone and with some help from this website for the blue slip and got the white slip. Since right now you have one year deadline to submit the things that they needed, I think the wisest thing to do is to get an attorney to look over your case, such as the attorneys mentioned on this website. I think it will help if you to go to China again and have the wedding ceremony, communicate more online in Chinese or English, here's a website to translate English into Chinese and visa-verse: http://dict.cn/ Get all that staff ready before submitting them. You have to do everything you can to show them that there's no doubt in their mind you guys have 110% bona fide relationship. Why were the chat logs asked for by the VO, or were they offered to the VO to look at? It would be best to see very, actual question and answer at the interview... can you provide that? often people give what they think the reasons were but more the Q&A has more hidden info than one thinks. Question asked where did we meet,, how long since we met,, how did you meet,, how many times did I go to China,, dates I visited her,,, how long did I stay,,, did I send her money,, looked at photos then looked at chat records, got up and went and talked with another man who works there,, came back and gave her blue,,, Blue is not the same as, "Denied, sent back to USCIS". Since she received Blue, what did they ask for? Blue is for more information, or more process. She received the white after the blue on 11/ 20 and being sent back to USCIS Sorry to hear about your denial tkgert. I have a good understanding of the feeling you are going through right now. My wife, than fiancee was also given the blue slip in December 08 and consequently received the denial in February 09. I went back to married my wife March 09 and filed for CR-1 and K-3 in early May. With the help of this website and all the great people who are willing to answer any questions you might have, you will be successful the next time around. There's not much you can do to change the K-1 denial now. I think the best thing you can do now is to go back and marry your fiancee and file for the CR-1. With the electronic processing for the CR-1, the process goes by pretty fast. I saw some people on visajourney.com got approved from the USCIS in one to two months. After that with the electronic processing and the help of the James shortcut to get all the documents ready to submit before it goes to the National Visa Center, you can get the interview day in about a month. I guess you already read through most of the posts on this website, if not they will be very helpful for you. Congratulations Rachel & Will, I can relate to how you feel right now. I felt like jumping on the couch like Tom Cruise on the Oprah show when my wife got the visa. To be able to overcame the bureaucracy of the US immigration system and start a new life with the love of your life is very special, something to remember and build on for the rest of both of your lives. Okay so basically he won't be getting the visa tomorrow when he goes back... he said they told him to come back at 2:30 tomorrow for the result, so after I've done some more searching on here, I'm assuming that the result will be the PINK, and he'll have to stay on in GUZ to wait to pick up the visa there. Bummer, I miss him When they ask for his passport, it's to put the visa in. Congrats. Question, my wife said there's nothing in her Chinese passport when she received it back from the consulate after approved for the CR-1. She was given a package and cover page with her information on it, it's that the visa? By the way, she waited four days to get those items after approving.

I want to give an update on our visa journey. My wife interviewed this past week for a CR-1 and was approved. She has the visa in hand and plan on arriving here in December. I want to give thanks to all those who help us along the way. Without you guys and this wonderful website, we would not have gotten this far. As a lot of you have experienced the injustice denial of your love one's visa, it's a mixed feelings of horror, anger, and despair. I was afraid of our K-1 denial might mean I will never be able to get my wife here, especially the how insensitive the GUZ embassy treated us the first time as all of you who have gotten denial experience knows. I was very fortunate overcame some of the possible causes of our denial and able to get approved for the visa in 6 1/2 months with the electronic process. There's is no template from the USCIS on the visa journey, but this great website has guided me along the way. I want to congratulated all of those who have gotten your love ones the visa, and offer support for those who are having difficulties in visa journey. Thanks Eddie

I dont have the answer to your question but I would like to know did you get your police certificate in China? I am an American and my husband lived in China for 5 years and NVC now need a police certificate from China and we are having a hard time getting anyone to help us. My wife is getting the police report now. She got one from our previous K1 visa but it expired. I guess they changed the expiration on the police certificate to 1 year. I thought it was good for 3 months when we got it last year.

How to switch K3 visa to CR1

No, If the K-3 is at the consulate, and the CR-1 reaces the consulate before interview the K-3 is DROPPED and the CR-1 is interviewed for. Sometimes a CR-1 can be used as a back-up if the I-130 is on hold at NVC and I-129F has been forwarded to GUZ, if the K-3 is denied, I have seen a case where the petitioner then gets the I-130 moving through NVC and then interview for CR-1 and then get approved. NOTE: Lately I have not been seeing as many denials, from waht I have read GUZ has let go a couple of officers that were over using the "NON-Bonafide relationship" excuse. THINK PINK! Thanks for the reply, can you choose to send the CR-1 to GUZ and leave the K3 in NVC? So in case the CR-1 doesn't go through, we still have the K3 as a backup? My K1 visa was rejected and have sent CR-1 and K3 to USCIS, got the NOA1 and waiting for NOA2 for couple of months now. I see some CFL members with K1 rejection have the NOA2 within a week, a month or two months. The USCIS website said it process the applications in the order it was receive, why is it taking some applications longer than other to get the NOA2. Frustrated with the process No, K-3 passes through NVC with minimal processing and NO interaction with petitioner, basically NVC assigns a case number and sends it on to the consulate. Note, sending I-129F in for the K-3 option slows USCIS process down in I-130 while they match the 2 petitions up, they have been approving both petitions on same date and sending to NVC together. You should get NOA2 for both I-129F and I-130 on same date. USCIS process varies by name checks and case load at VSC and CSC. Thanks dnoblett -

Where is your CR-1 now? It might have some catching up to do.
