  1. Hi, My wife just got her k-3 visa. It says it expires in two years. Does that mean she can stay in the U.S. up to two years with K-3 visa? Now her CR-1 P3 is in NVC, how do I change her status to permanent resident in the U.S. instead coming back Guangzhou for her CR-1 interview? It's so hot in Guangzhou.
  2. My wife's K-3 interview date was set near end of June, 2007. Now almost 2 weeks till interview, she still hasn't receive her P4 in the mail. I have contacted GUZ through email and they informed that it was mailed on May 30th and she should be getting it within two weeks. It has been more than 2 weeks. My wife was advised by 001 site to get it directly from GUZ on the day of the interview.
  3. Hi, my SO's K-3 is under administrative process for 7 months now. Does this mean IMBRA has something to do with it even though I filed her K-3 in Jan 2006 and K-3 approved in April06? But her CR-1 is also in NVC under administrative review for two months now.

  5. Hi, I just found out about the IMBRA law today. Well I am just curious if the VO at GUZ actually supply your SO the petitoner's background check info to your SO in Chinese at the interview in GUZ after March 6th 2006? If so, does this apply in K-1 and K-3 interview only or it also affects CR-1 interview?
  6. The immigration lawyer said that the petitioner or husband will also go through name check. So are any of the petitioners's own name went through background check at NVC too?
  7. My wife's CR-1 case has reached P3 stage. My understanding was that once NVC received her DS-230 Part 1, they will review and send it to Guangzhou, then from GZ will ask for the name check. But I called NVC today and they said she's under administrative review and NVC said it's for her name check a standard procedure for everyone. Does this mean GZ does not acutally do the name check for CR-1?
  8. That's right. So if we take this point and the point you are at now (just received P3)... you need to return P3. I'm not clear if you already paid the IV fee or still need to. Once it leaves NVC, it can be 60 days or more to get into the GUZ computer. There's nothing you can do for the K3; but keep pushing the CR1 along as best you can. You'll have that two month lull waiting for it to get into the computers... So, as Mike and I are saying, hopefully the K3 namecheck will finish by this time... Admin review could be something other than namecheck... and it could be completed fast or slow... you just don't know. I would be inclined to call DOS and ask them specifically if the namecheck is completed and see if they can see this as a distinct issue from the admin review. Maybe it flipped into admin review after the check (or before)... 237406[/snapback] I have paid $380 for DS-230. We are in the process of returning P3 to NVC. What's the deal with administrative review? I heard this happens to K-3 but I haven't heard any CR-1 with the same problem. It can happen at any stage of any of the spouse or fiance visa categories. 237413[/snapback] Thanks for all the help. So I heard for CR-1 Packet 3.5, if there is a hit on her namecheck, NVC will require my SO to take a fingerprint. But why didn't NVC ask my SO to do this for her K-3?
  9. Hi, Number 20 on DS-230. My wife lived at her current address all her life. But they only ask address after 16 years old. Can she put the dates from her 16 years to recent or from her birth till now?

  11. HI, My wife's K-3 visa is currently under administrative review. Her CR-1 case P3 is on the way back to NVC. Does the K-3 visa name check affect CR-1 in any way?
  12. Hi, My wife received her packet 3 for her CR-1 Visa. The instruction asks her to send the packet back to NVC. But she was told that the packet 3 for CR-1 should be sent to Guangzhou instead. I would like to know. If we sent the P3 to NVC, is NVC then will send to Guanzhou. Or if we sent P3 to GZ, then GZ will send to NVC. Which way is faster?
  13. First you Aunt would not be your co-sponsor for 2005 taxes. She is your "co-sponsor". Her filing requirements are the same as yours. I would include tax returns which INCLUDE W2 forms. This will clarify your Aunt's actual "income". 222531[/snapback] Thanks for the info, I was told by NVC or DOS today that I should add my wife to co-sponsor my Aunt's three household which becomes four. I dont know exactly how much my aunt made for 2005 but to be safe I feel like taking out her daughter, who went to college and did not live with my aunt and her husband in the 2nd half of 2005. This will make the requirement back to three people. Can I do this?
  14. Hi, I am currently working on my wife's CR-1 I 864. I just started working this year 2006. So I have a co-sponsor for the 2005 tax return. My aunt is the co-sponsor. She has 3 people in her household and her income for 2005 was $21,000. It meets the requirement but she filed the tax return with her husband who on the tax return has negative income, therefore at their combine tax for 2005 was negative. My question is does NVC or DOS looked at my aunt's income 2005 only?
  15. That first line of your timeline is a double whammy. A Chinese immigrant marrying a PRC citizen can bring extra scrutiny to the case. Not only are there many such fraudulent relationships but often you may have either two common Chinese names and/or (in the case "Will" took a Western name) a name change complicating the security check. The best you can hope for is a quick resolution but the only thing you can DO is keep checking. 221319[/snapback] Correct me if I'm wrong, PRC Citizen is someone who was born in a foreign country and later became U.S. Citizen. Well I became U.S. Citizen in 1997. I had my English name since 1992. I dont think there is anything wrong with me especially when NVC told me so. They said they are checking on my wife. So I guess it could be the common name issue. But here is the twist, although her K-3 visa is under administrative review. I called NVC today and found out that her CR-1 visa has been sent to Guanzhou on May 29th, 2006. So what the heck is going?
