  1. I had a very similar situiation as your SO about the birth certificate. I was born in 1976, and I don't have a hospital birth certificate as the newborns get now in China. If your SO can contact her birth hospital and find her birth info, that will be a way to let hospital issue a certificate.

     

    But I end up got a birth certificate from Pai Chu Suo of my Hukou(»§¿ÚËùÔÚµØÅɳöËù) through a friend, who knows the leader of my Pai Chu Suo very well. Which means Pai Chu Suo do not obligate to issue it for me.

     

    it simply lists that when and where I was born; both my parents' name and birth dates. Then i took this piece of paper to the notary office, they notarized it for me. That was all i need.

     

    The instructions for the I-130 process mention a "long" birth certificate. I don't know if these instructions are specific to China, or if they are meant to apply vaguely to all countries in general.

     

    My wife was born in China in 1972, and she's not sure she has a birth certificate, still less a "long" one.

     

    So, a few questions ...

     

    (1) If she manages to find her birth certificate, how can we decide if it's the required "long" one (versus a "short" one)? What does the thing look like? How long is "long" ?

     

    (2) If she can't find it, where does one go in China to get a birth certificate ?

     

    (3) If she can't get a birth certificate, what is an acceptable substitute, and where do we get that ? As far as I can tell, there's a thing called a "Notarial Birth Certificate" (Chu Sheng Gong Zheng Shu or Chu Sheng Zheng Ming Shu -- which one?) that we can get from a Notarial Office (Gong Zheng Chu). Is that correct ?

     

    (4) What documents will we need in order to get this "Notarial Birth Certificate" ? Is her household record (hukou) sufficient ?

    I would say you are very lucky!

     

    My case has been over 1 year, and I just had an appointment to get my passport stamped, the woman took me told me that now it takes two years to get 10 year green card!!!???

     

     

    Here's our updated I-751 timeline:

     

    05/31/09 - Sent I-751 petition to USCIS

    06/08/09 - Received NOA letter

    06/20/09 - Recieved ASC Biometrics Appt Letter

    07/08/09 - Biometrics Appt at the Oakland ASC

    07/25/09 - Petition to remove conditional resident APPROVED! (letter recieved on 7/31)

    07/28/09 - Card production ordered (received email status on 7/29)

     

    The entire process took less than 60 days. Has anyone else experienced such a fast turnaround? 2 years ago I had a friend that went thru' the same process...it took 13 months for her to get the approval! Is USCIS really getting more efficient?

    Brief recap/timeline of I-751 Filing for wife & Daughter:

     

    - I-751 form submitted via mail - received at VT Center: 2/4/09.

     

    - Received I-797 (NOA) for Biometrics on 2/12/09.

     

    - Biometrics completed on 3/14/09. (BTW: both wife & daughter did Bios on same date even though they had different appointment dates - just ask)

     

    - I-797 (NOA) received to say 'Card Has Been Ordered' on 7/14/09.

     

    - I-797 (NOA) received to say 'Congratulations! Your request for the removal of the conditional basis of your permanent resident status has been approved' - received 7/18/09.

     

    - I-551 (Green Cards) received 7/20/09.

     

    This was actually pretty quick. So I am pleased.

    I called USCIS£¬ obviously the guy took my call had no more information then i do although he checked around for several minutes on the computer.

     

    So I decided to make a infopass appointment, since i will take a trip in september when my now green card will be expired by then.

     

    Next Tuesday will be my infopass day.

    There are three things you can do - the InfoPass appt, file an CIS ombudsman case, and write your congressman.

     

    You can space them out one every three months (like we did for Jiaying's case), or try all at once.

     

    Sen John Cornyn is the only congressman who actually read and responded to what we said, although in the end, he simply passed along what the USCIS told him. The other two (Sen. Kay Bailey Hutchison and Rep. John Culberson - same as yours) responded with what they were doing about illegal immigration.

     

    They'll probably respond more quickly to your inquiries - for us, they used the excuse of their "improved service" because of the fee increases to not investigate.

    yuliki: Hang in there, I have seen cases like yours before.

    in fact my wife has a few friends here in the U.S. on a CR1 and it took them 12-14 months to get 10 year GC.

     

    My wife and I are also CR1 and just started the I-751.

    We have/had our Bois app for next week 7/7/09.

    But just yesterday we received a cancellation notice in the mail.

    I only get the Texas Service Center and the Vermont Service Center that lists the I-751 and their processing times are 6 months.

    I think I would call around and ask whose got your I-751,,over a year is way too long.you can also schedule an Info pass appointment and ask what is going on.

    I have seen a few go beyond 1 year, you can schedule an Info pass appointment and ask what is going on, as well as get an I-551 stamp.

     

    Another thing you can do is file an N-400 if you have been married and living with a US citizen for 3 years since getting your first green-card, USCIS cannot start working on the N-400 before the I-751 has been approved, this tends to get them to jump start the stalled I-751.

    good news everyone. my lao po received her 2 yr. gc in the mail today. yee hawwww! she has been on the phone all day calling her friends, hehe. it took 6 months and 3 days, but we lost a month due to an rfe for the medical exam that uscis couldnt locate. happy days for 1 yr. and 9 months until time for lifting of conditions. btw, our online case status still shows pending, so it seems to be hit or miss with the online status.

    A girl that I know in here Houston, She submitted hers last March, and she just got her 10 year-green card this March.

     

    So yours is pretty quick! I am looking forward my card now......

     

     

    We received notice in the mail that my wife was approved on March 23rd for her 10 year greencard. Submitted the original paperwork in May of last year. Had biometrics in 06-08. Transferred from TX to VT in October.

  11. Yesterday, got a letter from USCIS, is notified that my case had been transfered from VM service center to CS service center.

     

    Anybody knows that means faster or slower? :lol: :unsure:

    Hi - good to here from you again. They took so long processing Jiaying's AOS that we got the 10 yr card instead.

    It looks i'd better get a stamp cause i want to stay in China for almost half year. Of course, i will wait to March or April to see what is going on of the process of my I-751.

    We are planning a trip back to China June or July of 2009, I have the letter that shows my visa had been extended one year. So I just need take this letter with me when we are traveling? or something else I have to do to show that i am a legal green card holder?

    Yep, just the letter and expired green-card.

     

    Note it is not extending your visa, it extends your permanent resident card (Green-Card), the visa was canceled long ago when you entered the USA, or were approved for the green-card in the case of K-3.

     

    Note: The letter is only valid for 1 year, if approval of I-751 has not happened by then, then schedule an info pass appointment to get an I-551 stamp in passport to provide evidence of permanent residence status beyond the 1 year extension.
