  1. You are correct. We are considering filing the I-131 so that she can join me in China while trying to wait out the AOS process, but don't know if we want to wait that long. We are also worried that even if she gets the greencard, she could be deemed as having abandoned it if we are both living and working in China. I am trying to figure out if she can keep her PR status if we take appropriate measures to maintain a minimal presence in the US, but I'm hearing that it is hard to determine. We would like to avoid having to go the DCF route when we eventually decide to return to the US, but in case we do withdraw our AOS or lose PR status, I would like to cover my bases.
  2. I am about to take a job that would have me work in China on an F visa. My wife and I are thinking about getting the DCF eventually. I have been reading on this forum that a Z visa is required for the petitioner, but has anyone done it on the F? It also sounds like the important component is the residence permit. If that is enough to show residency, can I get a residence permit while on the F visa?
  3. My wife's AOS application is pending name check but I just got a job in China. I would like to take it, but am concerned about the effect my/our moving abroad would have on the AOS application. We are considering having me relocate first with her joining me after she gets her AP or greencard. If I leave the country, I figure that I would have to report that to USCIS and I am concerned that it would be viewed poorly in regards to our application. Worse, if she comes with me on an AP, would USCIS consider that an abandoning of the application? I guess the way around this is to maintain a US mailing address. This would be easy to do, but I don't want to get in trouble for not actually living there. What should we do?
  4. Hi all, Couple of questions on AP: 1) We would like to have the AP in case we need to travel outside of the country. So how should we fill out the "intended departure date" and "expected length of trip" fields if we don't have specific plans? And is it enough of an explanation to say that we want to take a vacation or see relatives? 2) The form still asks for a three quarters photo (form says revised Oct. 2005). Can I safely assume that it has changed like the rest of the photo requirements to passport type? Thanks
  5. This whole thing went more smoothly than in my wildest dreams and we couldn't have done it without the great information on this site. I submitted the I129F for K-1 on June 8, and she passed the interview today. The process must be really speeding up. Best of luck to everyone. (she says that the interview lasted less than a minute, and the VO just asked where she is from and where I live now)
  6. Our file was approved and sent out by NVC on July 1. After not receiving a P3, I emailed GZ and they told me on Aug. 10 that they had not yet received the file from NVC. I called NVC, who admitted that it was abnormal to take so long for the package to get from them to the consulate and told me to fax them a copy of the email. Has anyone else experienced this? Is there anything else that I can do?
