  1. GUZ had an I-864 on file that I submitted in 2008 but they wanted one specific for the current year. In her first interview one of the reasons she was given the white slip was for her english. We overcame that and proved that she could speak english to USCIS so GUZ couldn't deny her any more using english as an excuse. So I guess they didn't bother making her conduct the entire interview in english since it wasn't an issue. The one english question was "What did you and your husband do yesterday?" She answered "We were at the airport" My flight to Shanghai had been delayed so I hadn't arrived in GUZ until the previous day. So it was an easy question for her to answer.

  2. My wife's second interview was on the 30th. The interview went well they asked her one question in english and conducted the rest of the interview in Chinese. She passed the interview but they decided that they needed an updated I-864 from me. She had 3 years of tax documents and a copy of the I-864 they already had on file. So they gave her a call back letter and I typed up a new form and reprinted my most recent tax form. Unfortunitly since it was a holiday we had to wait until Wednesday the 6th to go back and turn it in. When she got there she discovered that only general staff was working that day and they couldn't offically approve her. So they gave her an appointment slip to return on Friday. So we went back on Friday. She was in for about 15 minutes and got the Pink. But since it was a holiday she has to wait until Thursday to be able to pick up the visa. I had to come back to the US on Saturday so she will have to pick it up without me. I am just glad it is finally over. :D

  3. My wife just told me she got a call from GUZ. They are giving her a second interview and wanted to verify her address and phone number. They called her on the phone and said they needed to get her phone number??? :blink: They should already have all this on file. Sounds a bit strange to me.

    I wish you good luck for your wife's coming second interview.

    I believe they will give your wife the visa this time.

    If you don't mind, can you tell me if you had to submit the rebuttal to have

    the case reaffirmed?

    How long you had to wait to get the NOIR from USCIS?

     

    We are still waiting for the NOIR from USCIS and it's about 4 months since

    they received the case back from Guangzhou.

    Yes we had to submit the rebuttal. Sent them a box of supporting evidence. Be patient it took us about 6 months to get the NOIR letter. I then took a trip to China to gather the last bit of evidence I needed and mailed it all in. Took about 1 month for our case to be reaffirmed. Now we are waiting again. I called DOS and we are now in AP. Hopefully it will just be a short delay and we will find out if we need to have a second interview.

  5. Our I-130 was reaffirmed on June 18th our file arrived back in GUZ on July 21st according to DHL tracking. No significant delay at customs it must have been shipped in a diplomatic pouch. No word yet on whether or not we will have to have a second interview yet. I am guessing it will be in September if she has to have one. Heres hoping she won't need one. Not much left for them to nitpick and we have been married over 2 years now. Good luck to all of us.

  6. 9 MONTHS for Me

     

    Just got reaffirmed. USCIS received my file back from GUZ last September and that was after a 4 month wait just for GUZ to send it back. I received my NOIR April 12th and gathered the requested evidence. The return enevelope they sent was a joke. I sent them back a BOX of evidence. There was no way to send a proper responce in a letter sized enevelope. Our case got reaffirmed on the 18th. Now it is another waiting game to see if we will need to go to a second interview. Good luck with your CR-1.

  7. I met with her at ACH and she came across to me as being very rude. Wouldn't give me any details and wouldn't go over the interviewers notes with me. Said couldn't take the additional evidence that I had because the case was already packaged for return to US. However, I later found out that it was authorized to be mailed back on the day I was there and they held it in the mailroom for months. I was there in May and it only reached immigration at the end of september. The NOA was mailled on the 25th and there has been no further activity yet.

  8. You should go if you can but it may not do you any good. My company wasn't able to give me time off for the interview and my wife got the bone fied relationship white slip even though she had a letter from me and my company. I went to the session 2 weeks later and they wouldn't tell me anything but it is in the computer that I was there which is a plus. I was in Guangzhou in May and our file arrived in the US last week and was sent to USCIS on Tuesday. Hopefully we will get a quick response. Expect for your file to bounce around the mailroom for a bit before it gets sent back. It should arrive in the US in about 3.5 to 4 months.

  9. You can file a new I-130 but you must still respond to any letters sent to you from your original application. If they revoke your first application any restrictions on reapplication will cause your new application to be denied as well.

     

    Have you got any letters from USCIS yet? They may give you an opportunity to submit additional evidence in support of your case if your application hasn't been revoked yet.

     

    If USCIS has revoked your application you may have the right to appeal but most likely the appeal would be denied. Your best chance is to try and get the application reaffirmed by USCIS. I would wait before filing another application because if your first application is revoked then you will have just wasted your money because they won't refund it.

     

    I am waiting to get the first letter from USCIS after GZ recomended our denial. I still don't really know why it was denied for certain. But I have my congressman helping us and have been told we will have an oportunity to submit additional evidence assuming they don't reaffirm the application after reviewing our case.

  10. Not that it did much good but I was able to speak with the IV chief during ACH. I couldn't get time off to go to the interview and my wife got denied with the bone fied relationship excuse. I was alble to make an emergency trip to China 2 weeks later with a letter from my company explaining why they couldn't give me time off in case that was the reason for the denial. The officer wouldn't give me any additional details or accept the evidence. So I ased to speak to the IV Chief and I had to wait until the end of the session but I was able to speak to her and she also told me nothing. It was still good to go because the put in the system that I was there which I needed to do in order to fight the white slip.

  11. I just went to ACH last week to get the details on my wife's denial and to ask them to accept further evidence. It was mostly a waste of time. I even got to speak to the unit chief and she wouldn't tell me anything either. No matter how much I insisted I couldn't get any details from the interviewer's notes. All they would tell me is that they suspected fraud that she just married me for immigration purposes. They wouldn't take any additional evidence either claiming that her file was already packaged to be sent back to the US. The only thing I accomplished was getting it put in her computer file that I was there and spoke to the officers. I think GUZ tries to block you as much as they can from overcoming white slips while the file is in China even though they are supposed to accept additional evidence. You need to go to ACH if at all possible to increase your chances of overcoming the denial once your file gets back to the US. I was told by a lawyer that it is much harder to appeal if you don't go.

  12. Swine Flu has cause the Chinese Embassy to delay issuing visas. I will have my visa next week on Wednesday. I am leaving that Thursday or Friday and it looks like I will be meeting my wife in Nanning before going to GUZ. I am booking the plane ticket tomorrow. The following Monday is my last chance to submit the evidence since the next monday is memorial day and the embassy is closed. Everyone I spoke to said that if I don't go before the 30 days are up I will have a hard time with any appeal. By going now and getting them to take the additional evidence it becomes part of our case file. So even if we don't get another interview or the visa now there is a chance USCIS will reaffirm the application and I won't need to appeal. Wish us luck.
